Lawyer acquitted in federal court in Georgia
Friends of the blog, Tom Withers* and Craig Gillen, walked a lawyer (Mark Shelnutt) today in Columbus, Ga. Shelnutt was charged with money laundering and drug offenses. The judge read 36 not guilty verdicts: At 2:45, Land began to read. "Count One, conspiracy to launder money," the judge said. "Not guilty." "Liberty City terror suspect gets 6 years in prison"
The first of the Liberty City defendants -- 24-year-old Burson Augustin -- was sentenced today. The government sought the maximum -- 30 years. But Judge Lenard did the right thing and sentenced Augustin to 6 years. People learn much more effectively if they spread out their learning over a period of time, rather than cramming, and if they are tested as they proceed, rather than at the end. Fix the ScanSnap
Today I was going to upgrade my OS to Snow Leopard. Literally minutes before I was going to shove the Snow Leopard disk into my iMac, I got an email from my friend Jonathan, a Lynnwood DUI Lawyer. Adjuster Law: Not Enough Damage to the Car
I sent a demand package to an insurance company on a car wreck case with about $26,000 in bills for medical treatment and two herniated disks. The adjuster wanted us to get information on prior medical treatment because of the severity of the claim, they felt there had to be some pre-existing condition. We complied because that was information that we would need to gather if there was a lawsuit anyways. When that didn't turn up anything, the denied any payment. The reason? Not enough damage to... So far this is been pretty informative. Guy Kawasaki kicked off the morning in the Keynote, if you've not heard Guy speak before, he's fantastic. Maryland Court of Appeals to Determine What Professional Activities Qualify Doctors to Testify as "Medical Experts"
Medical expert witnesses in Maryland could see rules tightened in connection with their ability to testify in court as an expert. In 2004, Maryland issued a law that prevented any doctor who devoted more than 20% of their professional time to working on personal injury cases from testifying as a "medical expert." Expert Witness Communications Rule May Be Expanded
The Judicial Conference of the United States recently proposed an amendment to the Federal Rules of Civil Procedure that would have an impact on expert witness communications. Specifically, the rule would expand the range of communications covered under the work product privilege between attorneys and expert witnesses. The rule change recommendation, as well as another governing summary judgment, must first be adopted by the Supreme Court before going into effect. Check out the full WSJ story. My client in the so-called "murder for hire" case that was featured on Nancy Grace a year or so ago entered a no contest plea this week. She will serve 15 days in the county jail and can serve the time on weekends. Pretty good outcome considering that she could have received 25 years in prison if found guilty as charged. Okay, I admit it. I fell in love with another PDA/cell phone. My last love was a Motorola MPx200, which I bought from AT&T wireless back in 2005. It had everything I wanted: email, calendar and contacts that sync with outlook, voice recorder, MP3 player, high quality display screen, and a small clam shell design. Ernie the Attorney had an interesting post yesterday asking how the headnotes in West digests encourage lawyers to write long-winded sentences. This blog's official position on split infinitives is that they're okay. The Star Trek catch phrase - "to boldly go" - is A-okay with us. Blackberry caused traffic pile-up
In Seattle, a 53-year-old was looking down at his Blackberry and caused a five car pile-up. Ooops!!! Statistics on 57,000 vehicle collision during the first six months of 2006 show that drunken driving, drug use and excessive speeds contributed to 92.5 percent of collisions in the state. But state officials also have started tracking accidents caused by any of 12 driver distractions, such as using handheld computers and cell phones, that account for the remaining 7.5 percent. Google came out with a cool and free application that I think will change the way some lawyers search. My law firm will not be giving up our Westlaw and Lexis accounts anytime soon, but with free search tools like this, I can see that happening in the near future. At first I was filled with dread at the thought of more ways to search on Google, don't we already get enough? So much information pops up and sifting through the search results are already time consuming and sometimes overwhelming. I've often resented those "advanced search options" offered on some websites. In a move with possible profound implications, Google Scholar has added a dedicated search for legal journals and court opinions. Check it out here. Adjuster Law: Not Enough Damage to the Car
I sent a demand package to an insurance company on a car wreck case with about $26,000 in bills for medical treatment and two herniated disks. The adjuster wanted us to get information on prior medical treatment because of the severity of the claim, they felt there had to be some pre-existing condition. We complied because that was information that we would need to gather if there was a lawsuit anyways. When that didn't turn up anything, the denied any payment. The reason? Not enough damage to... UPDATE: Make sure you are running the latest version of ScanSnap Manager v. 22L11. You can download it from Fujitsu here. So a lot of Mac users who use a Fujitsu ScanSnap are having problems once upgrading to Snow Leopard. The main problem seems to be the upgrade breaks the ability to scan to a folder from the Quick Menu. Turning prospective clients into paying clients
As I've progressed down the road in opening my practice, my attitude towards getting clients has fluctuated. Before I hung out my virtual shingle, I figured that I would focus on getting pro bono clients for the first couple of months and build through word of mouth. So this is very exciting. I actually had a potential client call me out of the blue. I was so astonished I totally flubbed the call. Today I was going to upgrade my OS to Snow Leopard. Literally minutes before I was going to shove the Snow Leopard disk into my iMac, I got an email from my friend Jonathan, a Lynnwood DUI Lawyer. While setting up some merge templates in Pages, I got an email from Andy Warwick, a web designer/programmer in England, who developed a great widget for Daylite.
