    Bailiffs are indispensable to maintaining order in court. To that end, court systems often treat bailiffs much like law enforcement officers, even arming them with firearms or tasers.     The FBI is warning U.S. law firms to beware of hackers. The FBI said this week that hackers are using phishing e-mails with malicious payloads to target law firms and public relations firms.     DNA Evidence Can Be Faked

    In a recent article in the NY Times (registration may be required) scientists in Israel have demonstrated that it is possible to fabricate DNA evidence. The team that has developed this procedure hope to cash in on their find by selling a kit that will tell whether the DNA has been fabricated. Privacy experts worry about some of the ramifications of fabricated DNA, including genetic testing problems. For prosecutors, this could represent a significant shift in the use of DNA evidence.     Another Man Released in Texas on DNA Evidence

    These stories are too depressing to write about. Today, the Dallas County District Attorney's (DA) Office announced that Patrick Waller, 38, is the County's latest wrongfully convicted citizen. Waller, who is represented by Gary Udashen, has spent the past 16 years in prison and was serving a life sentence for aggravated robbery with a deadly weapon, along with two 30-year sentences for aggravated kidnapping which arose from the same incident.     Oh, nope. Just finally getting around removing Nelson Mandela from the U.S. terror watch list.     When I read about the "heat burst" that hit Nebraska yesterday, it was the first time I had heard of the phenomenon and thought I'd pass the strangeness along. It seems that these would be especially dangerous in cities like Phoenix. "Cozad residents woke this morning to a weather phenomenon as a heat burst rolled through town.     Will the Conservatives ban referral fees?

    The Law Gazette report a very interesting comment from Conservative MP Henry Bellingham from the Motor Accident Solicitors Society's annual conference. Apparrently he said a Tory government would "almost certainly" review referral fees and furthermore "[Shadow Justice Secretary] Dominic Grieve is very anti-referral fees. Very much like the LIIBULLETIN-NY project we launched in 1996, which comprehensively provided student-written summaries of New York Court of Appeals cases for nearly a decade, Media Alerts provides summaries written by law students under faculty supervision.     I absolutely loved the book. And I love Sandra Bullock for her strong, but quiet, assistance to Warren Easton Charter High School, which struggled to rebuild after Hurricane Katrina.     Another reason why lawyers write excruciatingly long sentences

    There are so many reasons why lawyers write those tedious run-on sentences, but let's focus on one that probably afflicts my generation more than the more newly minted lawyers. How many people regularly use the 'Digests'? You know, the headnotes maintained by West that are filled with blurbs about legal principles.     Study Finds Alarming Rate of Medication Overdoses Among Kids

    The American Journal of Preventative Medicine reports that more than 70,000 children are poisoned each year by prescription or over-the-counter medicines. This figure is more than twice as many children as are poisoned by other products. According to the study, most children are poisoned by acetaminophen, which is used in Tylenol, or opioid painkillers and benzodiazepine antianxiety drugs.     MDs peddling BS: Shedding Light on Doctors’ Conflict of Interest

    The Washington Post reports that determining doctors' ties with pharmaceutical companies and any related conflict of interest are often hard, if not impossible, tasks for patients. The Physician Payments Sunshine Act, introduced by Sens. Chuck Grassley and Herb Kohl, seeks to relieve some of that burden by requiring all payments more than $100 made by a drug or medical device company to a doctor be reported.     The Consumer Product Safety Commission announced a voluntary recall of five "Little Tikes" toys, after an infant choked on a plastic nail included in the sets.     PG County Added To Case Search

    For those of you that missed this, Prince George's County recently added their records to the Maryland Judiciary Case Search. The FAQ page shows that the system now has civil dockets back to 1986 and criminal dockets back to 1982. This book is part biography of Maximilien Robespierre and part history of the French Revolution. You don't have to be a Francophile, though I probably am, to enjoy this book.     Normally I would never advocate something like a boycott of the Olympics. The Olympic games are very important to me, and I don't want to rob any of the athletes of the experience.     I'm probably the only person apart from Jonathan Adler's mom who enjoys the Volokh Conspiracy's Sunday Song Lyric feature. This ain't no music blog, but we all have to start somewhere. The song presently stuck in my head is "Crazy Man" by the duo of Catherine Irwin and Janet Bean, working together as Freakwater. The song comes from the 1993 album "Feels Like The Third Time".     Being sued v. being threatened with a lawsuit

    I think it's hard sometimes for people to figure out whether someone has actually sued them or whether they've just been threatened with a lawsuit. Here are some ways to tell. You've been sued when someone has filed a complaint with the court. In order for the lawsuit to properly begin, you have to be "served" with the complaint.     Communication is key add-on

    Just a quick update to my previous post. I spent the last two and half days at a training put on by my state's legal malpractice insurer. And yes, this training was voluntary. Apparently, the biggest source of client unhappiness with their lawyer is lack of communication - my lawyer doesn't listen to what I say and I don't understand what my lawyer says.     It can be hard to judge whether the lawyer you're hiring or have hired is any good. One of the problems is that there are many, many variables in any legal situation. Lawyers aren't supposed to guarantee a particular result or outcome and you should be very, very suspicious of one who does.     Filing a libel lawsuit isn't always about fixing some measurable damage to your reputation. Sometimes, people want to send a message. A few days ago, Horizon Group Management LLC filed a lawsuit against a tenant who complained about the company on Twitter.     On Saturday, we were looking for something cool to do that met our somewhat restrictive budget: $0. We wanted to do something active and outdoors so we decided to spend the afternoon at Fullersburg Woods forest preserve in Oak Brook. Fullersburg has a great nature center, and lots of trails.     The VBAC Facts blog has a great explanation of the legalities of VBACs and homebirth. To summarize, VBAC is legal everywhere in the US.
