Analysts: More U.S. LNG Exports Unlikely

Industry analysts have told Reuters that they believe it is not likely that the United States will export significant additional quantities of LNG in the coming years despite forecasts that U.S. gas supply will outpace domestic demand. The analysts cited the relatively higher costs of producing gas in the United States, logistical challenges of aggregating gas from disparate shale plays for export, and potential political obstacles. Massachusetts Questions Weaver's Cove Analysis of Regional Gas Market

The Massachusetts Department of Energy Resources provided comments to FERC this week regarding a regional natural gas market study submitted by Weaver's Cove Energy. The Department asserted "that it is unclear to what extent, if any, Weaver's Cove's LNG supply is needed either to meet the region's gas supply needs or to reduce fossil [fuel] use in the region." The comments are available in the FERC eLibrary under Docket No. CP04-36. Posted on November 20, 2009 at 12:54 pm

Federal Stimulus Funding Fuels DOE Loan Guarantee Program

The American Reinvestment and Recovery Act (ARRA) appropriated $6 billion to the U.S. Department of Energy's (DOE) Title XVII Loan Guarantee Program to support loan guarantees of up to $60 billion for renewable energy and electric power transmission projects. The DOE Loan Guarantee Program was established under the Energy Policy Act of 2005 and was designed to support eligible projects that use new and innovative technology to avoid, reduce or sequester air pollutants, including anthropogenic... DOE ARRA Funds Begin Roll Out

As we enter 2Q09, entities across all sectors of the energy industry are growing anxious to see how-and when-federal agencies will open the spigot on American Recovery and Reinvestment Act of 2009 (ARRA) funds. For its part, the Energy Department answered in two requests for proposals. Congress appropriated to DOE nearly $21 billion in ARRA funds, divided principally between the Office of Electricity Delivery and Energy Reliability (OE) and the Office Energy Efficiency and Renewable Energy... White House OMB Clears Way for EPA's Proposed Endangerment Finding on Greenhouse Gases

The White House Office of Management and Budget (OMB) completed Monday its review of EPA's proposed finding under the Clean Air Act that emissions of greenhouse gases (GHG) endanger public health and welfare and concluded that the so-called "endangerment finding" will not in itself significantly affect the economy. OMB's conclusion clears the way for EPA to begin regulating GHG emissions from sources subject to the Act. Notwithstanding OMB's narrow analysis and conclusion, future regulation of... Maine and FERC Sign MOU

On August 19, 2009, the Federal Energy Regulatory Commission announced the execution of a Memorandum of Understanding between FERC and the state of Maine to coordinate procedures and schedules for review of tidal energy projects off the coast of Maine. Although FERC characterizes the Maine MOU as similar to those signed with Oregon and Washington State, in my view, the MOU with Maine makes a more aggressive commitment to getting pilot projects in the water and provides a more specific procedure... U.S. Wave & Tidal Round Up

Oregon: Oregon is about to set sail on mapping its oceans, reports the Press Enterprise. According to Governor Kulongoski, who is quoted in the story, the data collected from the surveys will help identify marine habitats and select alternative energy sites, including wave energy sites. The mapping project is expected to take 2 years, and is being funded by a $5 million grant from NOAA and $1.3 million in state money. International Round-Up

Chile: Looks like Chile is a hotspot for tidal power. According to a United Press International story, a tidal power feasibility study for Chile found the country had a "unique" wealth of natural tidal sites that, if harnessed only up to 10 percent of available tidal power, could exceed the installed capacity of Chile's central grid. The study was conducted for the Inter-American Development Bank by Garrard Hassan energy consultancy, based in Bristol, England. Potential tidal sites include the... Carbon Harvest Energy

Carbon Harvest Energy's proposal to turn old landfills into no-waste energy producers has been in the news lately, with stories both in the Burlington Free Press and on Vermont Public Radio. Carbon Harvest Energy will be taking a defunct landfill-based methane facility in Brattleboro and turning it into an active, zero-waste, energy-producing facility. According to the Free Press article, the electricity, heat and carbon dioxide produced by the methane-fueled generator will all be utilized. The... The plain language of waste

In this weekend's La Presse, Fran&#xc3&#xa7ois Cardinal wonders why governments always play with words when making policy for what to do with our waste. After several revisions to its policy on "residual materials" (read waste), the Quebec government has reinvented the language of waste management. Instead of "dump" we say "sanitary landfill". We no longer "recycle", we "valorize". Yes, it's as silly as calling bald people follicly challenged, but the sad reality is that many governments (Quebec is by... Ships pollute far more than cars

Just came across an interesting article discussing the ecological disaster that is shipping. This largely has to do with the use of "bunker fuel" - a very low grade, high sulphur, diesel that is used by ships around the world. The article claims 16 large tankers produce more pollution than all the cars in the world. See the article here. Posted on November 22, 2009 at 10:59 am by Jonathan Brun

    Less amazonian deforestation

Progress is being made on reducing deforestation in the Amazonian rainforest. This is being done through satellite monitoring of ranches and the enforcement of laws and regulations. In fact, deforestation in 2008 was at its lowest level since monitoring began in 1988 - promising news. The reality is that the enforcement of laws drives behaviour and to have a real impact the government must be tough. Article in the New York Times here. Will Wyoming Tax Electricity Generated From Wind Energy Projects?

One of the bills sponsored by Sen John Schiffer, R-Kaycee, chairman of the Committee (legisweb.state.wy.us/interimCommittee/2009/10LSO-0126w4.pdf) proposed a tax of $.0010 upon each kilowatt hour for electricity produced and sold in the... New Tenant Eviction Requirements in Iowa

The eviction process (also called a "Forcible Entry and Detainer" or "FED) in Iowa is just a little more strict. A ruling from the Iowa Supreme Court today now requires that the landlord give personal service notice of the eviction hearing. Previously, under the Iowa Uniform Residential Landlord Tenant chapter of the Iowa Code (Iowa Code 562A), if a landlord was ready to evict and had followed the necessary "notice to quit" requirements, the landlord could give the tenant notice of the eviction... Read the Entire Agreement - Personal Liablity May be Lurking in the Document

We've previously posted on the subject of the danger of personal guarantees when entering into contracts through a business entity. Normally, the officer/agent of the company needs to sign such an agreement in his or her capacity in the company, and not in their individual capacity in order to avoid personal liability. A recent case out of the Iowa Court of Appeals clarifies that signing in your corporate capacity isn't enough on its own to limit your personal liability. In this case, which was... Steve McNair - Another Failure to Plan

Former NFL football player Steve McNair is just another too-common of an example of someone who failed to plan their estate with so much at risk. Carbon Capture & the Future of Coal

CNBC: A looming government clampdown on CO2 emissions is about to confront an already embattled U.S. coal power industry with two stark options: capture carbon or die. Legislation from Congress or tough new regulatory demands could make it costly to spew greenhouse gases, posing a serious threat to the nation's coal-fired power plants. With coal the single biggest source of carbon emissions, industry backers are pinning their hopes on technology to trap and store these emissions blamed for... Energy Surplus May Last

The New York Times: The recession was hardly anybody's idea of a good way to put the country on a sensible energy diet. But it may have done just that. Many coal plants whose emissions were spreading acid rain, mercury and the ingredients of global warming have not been running as much lately, and the price of coal was down by half in the last year - like the price of oil. Demand for electricity was down 1 percent last year and another 4 percent in the first half of 2009; ordinarily, electric... Posted on November 19, 2009 at 11:29 am by Edward G. Lanza

    Change of Mind for Copenhagen

With the climate change meetings in Copenhagen now less than a month away, it appears the goal of the meetings could be changing. The meetings next month were expected to result in a legally binding treaty among many nations to reduce their greenhouse gas emissions. Fifth Circuit Holds that Individual Citizens Have Standing to Sue Energy Companies for Global Warming

By April Rolen-Ogden In Comer v. Murphy Oil, the Fifth Circuit left open the possibility that the oil and gas industry may be privately sued for alleged contributions to global warming. In this putative class action lawsuit, Plaintiffs claimed that the defendants' operation of energy, fossil fuels, and chemical industries in the United States contributed to global warming.
