    Owners and Operators of Municipal Sewer Systems May Be Liable Under CERCLA for Contamination Caused by Third Parties

    A recent decision by the U.S. District Court for the Eastern District of California may re-energize plaintiffs who hope to recover contamination clean-up costs from public agency sewer system owners. In Adobe Lumber, Inc. v. Hellman (2009 WL 2913415), the court held that the City of Woodland may be found liable under CERCLA for contamination resulting from the discharge of the solvent perchloroethylene (PCE) into the sanitary sewer by a dry cleaning business located in the City.     I'm hearing through the grapevine that some of my law students were unhappy with the grades that they received on their group papers this semester. I told them to find a movie with legal ethics issues and write about those issues. (Sneaky way to reinforce what they're learning, eh?)     The SuperLawyers law school rankings are out (see here for a leak of the results). As I predicted (here), older and bigger schools did well; younger and smaller schools (except for Yale, which counts as "older") did poorly. I had emailed SuperLawyers to find out if its methodology was going to factor age and size of school into account.     On November 18th, the Ninth Circuit issued an opinion reversing and remanding a WD Washington decision that had precluded a biotechnology company from seeking recovery against a third party for contractual indemnity claims relating to a qui tam action. The qui tam defendant, Cell Therapeutics, Inc. (CTI), had hired the Lash Group to provide Medicare reimbursement consulting services.     DOJ announces FY09 recoveries under FCA: $2.4 billion

    At a press conference today, Civil Division Assistant Attorney General Tony West announced DOJ's FCA recoveries for the fiscal year which ended on September 30. According to the DOJ press release, the US recovered $2.4 billion under the False Claims Act, bringing to more than $24 billion the total recoveries since the 1986 amendments which revitalized the FCA.     US settles with one hospital, intervenes against another in outlier payment qui tam

    DOJ announced on November 18 that it had reached a settlement, of $3.02 million plus interest, with Trinitas Regional Medical Center in Elizabeth, New Jersey, and that it was intervening against Brookhaven Memorial Hospital in East Patchogue, New York. The purpose of the trip was to view a housing complex for gas drilling rig workers that Nomac Drilling wishes to build/install in Athens Township.
