Citysearch Click Fraud Class Certified--Menagerie v. Citysearch

By Eric Goldman Menagerie Productions v. Citysearch, 2009 WL 3770668 (C.D. Cal. Nov. 9, 2009) While we don't hear much about click fraud litigation any more, there are still some click fraud lawsuits percolating through the courts, including this one against Citysearch. I initially blogged on the case under a different name, Lambotte v. IAC/InterActiveCorp.. Lambotte is out as a named plaintiff and Menagerie Productions now gets the honor. The big news is that earlier this month, the judge... Posted on November 18, 2009 at 07:04 am by Eric

AALS Law & Computers Meeting in New Orleans

By Eric Goldman I'm pleased to announce the AALS Section on Law and Computers program at the AALS annual meeting in New Orleans on Saturday, January 9, 2010. This program was developed in response to the Call for Papers we did earlier this year, and I think this panel should be really interesting. Unfortunately, AALS misprinted the panel's composition in their program guide, so I'm hoping to correct the error here. Program Title: Law & Wikis Moderator: Eric Goldman, Santa Clara University... Keylogger Software Company Not Liable for Eavesdropping by Ex-spouse -- Hayes v. SpectorSoft

[Posted by Venkat] In what probably belongs in the "software doesn't surreptitiously record conversations, people do" file, a federal court in Tennessee rejected Electronic Communications Privacy Act and product liability claims brought by someone whose ex-spouse used software to log internet activity and communications. (Access a copy of the order here [scribd].) The case presented a now-familiar fact pattern of the use of monitoring (in this case keylogger) software by a spouse to keep track... Blawgger Ronda Muir and her unique approach to Practice Management

    1. In what capacity does your blog serve the legal community? I am a specialist in organizational development for law firms and law departments. I have an expertise in lawyer personalities, which in this industry has a major impact on how their organizations work. (The comment I usually hear from non-lawyers is "Isn't lawyer personality" an oxymoron?" So you can see we are up against a difficult market perception.) 2. Unlock the Power of Social Arbitrage

/**/ Following is a guest post from lawyer coach Martha Newman. What goes into the complex formula we call SUCCESS? Success involves leveraging the strong relationships you have built through your networking to OTHER people's advantage. Strive to make everyone around you successful - and you'll find success yourself. This is the notion of SOCIAL ARBITRAGE: a constant and open exchange of favors and intelligence. How does it work? From TechCrunch.com: Ever since last summer, Twitter's growth in the U.S. has been stalling. But in October, the number of people who visited Twitter.com from the U.S. actually declined for the first time by 8 percent month-over-month. Estimates released today by comScore put Twitter's domestic unique visitors at 19.2 million, down from 20.9 million in September. Forecasting Collections and Inventory Management

In today's unstable environment, driven by outside economic forces, higher associate salaries, and increased competition, law firm leaders are faced with the tough job of forecasting cash collections. Many existing forecast methodologies focus on production and collection realization. However, these models often fall short because they ignore the other drivers of collections, and do not provide any information about collections beyond the forecast period. A better model: 1) Forecasts bills and... Posted on June 12, 2008 at 05:00 am by Rick Rawls

    Twitter's New 'Retweet' Feature

Twitter has now rolled out its beta retweet feature to most users. Not all of them are happy about it. You will know if you have it when you go to your Twitter home page, where you will find a notice describing the new feature. Formerly, you could pass along a tweet of interest by adding "RT" to it. It would go out under your name and you could add your own comments to the retweet. Under the new feature, a new "Retweet" button is added to the existing "Reply" button under each tweet that... Today, Nov 16, marks one year from when a remarkable man, Paul O'Byrne, closed his human eyes for the final time. Think Your Clients Use Your Firm's Website?

If you think your website exists primarily for clients, think again. A lot of firms think about investing in pricey features that would be in a client-only portion of the website. Did you know that only about 1% of clients return to a firm's site after hiring them? And when they do, it's usually to find an address or phone number. Firms think about adding a payment feature or a document storage tool where clients can get their electronic documents without bothering the firm to send copies.... RESOLVING DISPUTES IN CALIFORNIA TRUST LITIGATION CASES

Management of trustee and beneficiary disputes and their resolution in trust litigation cases involve many variables. California trust beneficiaries have been given many tools which protect them against malfeasance by trustees. California fiduciaries are held to a standard of care. Trust documents often describe the standard of care of the trustee, but where they fail to specify the care, California law states that the trustee is held to a reasonable trustee standard. Do Something! Prioritize

In last week's post, I talked about using time as a competitive advantage in your practice because time is important to clients. Obviously, time is important to lawyers, too. Do you know how much of your time is wasted on a daily basis as a result of interruptions, lack of focus, non-urgent and non-important tasks? To get the best out of your work day, you must prioritize. This requires some planning and thought up front, but it will pay dividends. If the task has an important purpose and a... Can Lawyers Use Time as a Competitive Advantage?

An article recently appeared in the Wall Street Journal discussing how businesses can use the old adage, "time is money" when it comes to developing their products and services. (The Wall Street Journal, Beat the Clock: How companies can use time to their competitive advantage, Paul F. Nunes, Geoffrey Godbey and H. James Wilson, October 26, 2009, p.R6.) Although lawyers are used to thinking of "time is money" in the context of the billable hour and the lawyer's time, the article contemplates... Posted on November 13, 2009 at 10:39 am by Allison C. I recently received a review copy of the new book by Adrian Dayton, Social Media for Lawyers: Twitter Edition. If you're new to Twitter or don't know much about it, this book will get you off to a great start on one of the newest technology crazes. It is a quick and easy read, written in a breezy style by a fellow lawyer-turned-social-media-consultant. While you may balk at the price (it's $195 on Amazon.com, but you can get it at the link above at $95), if you think strategically about the... Posted on November 5, 2009 at 10:45 am by Allison C. Price wars

Around the time I started my recent survey on alternative fees, I had heard many accounts that a price war had broken out among large law firms, with some racing to the bottom to offer ever better deals. So I decided to include this question in the first few surveys: There is a lot of price pressure these days, and some say it is leading firms to bid on projects as loss leaders in a way that is not sustainable. Have you seen any examples of this? I asked the question of 15 large firms, and all... Posted on November 17, 2009 at 10:00 pm by Jim Hassett

New research on alternative billing: What it means to you

Are you trying to decide what to do about alternative billing, or whether you should be doing anything at all? You have a lot of company, because important changes are taking place. That's why I recently conducted in-depth interviews with senior decision makers from 37 AmLaw 100 firms about what works best for alternative fees, and what does not work at all. Participants included nine chairmen and managing partners, 16 executives (primarily CEOs, CFOs, and CMOs), and 22 senior partners, many of... Posted on November 10, 2009 at 10:00 pm by Jim Hassett

Alternative Fees Demand Improved Project Management

This is a guest post by Steve Barrett, former CMO at Drinker Biddle, who recently joined LegalBizDev to help us meet the demand for alternative fees webinars, workshops, and consulting. Alternative fees have been discussed with great frequency over the past 12 months, as the economic downslide has shifted buying power into clients' hands in the legal industry. Obviously, to implement alternative fees on a wide scale, a law firm must be willing to consider serious shifts away from the hourly... Posted on November 3, 2009 at 10:00 pm by Jim Hassett

Don't Fuss About The ACC's Value Index: Get With The Program

Paul Lippe of Legal OnRamp has an excellent piece in yesterday's The AmLaw Daily which supports what I wrote about last week on the subject (I love it when really smart people confirm one of my viewpoints - notice I only said "one"). Paul points out that ratings will happen whether law firms like it or not, and, in fact, always have (albeit less formalized) in the form of word-of-mouth ratings. And, just because the ACC Value Index evaluations can be negative, and not just positive (like... Posted on November 19, 2009 at 09:05 am

    Working out of your pocket!

Okay, I admit it. I fell in love with another PDA/cell phone. My last love was a Motorola MPx200, which I bought from AT&T wireless back in 2005. It had everything I wanted: email, calendar and contacts that sync with outlook, voice recorder, MP3 player, high quality display screen, and a small clam shell design. The only problem was that the cell phone range was limited and calls were often dropped or could not connect, or there was no signal. Not being able to use the phone was a problem!... Assess International Lawyers’ Emotional Intelligence Skills

As I prepare to leave for the annual International Bar Association Convention in Madrid, I have been thinking about how (most) law firms still do not fully assess lawyers before hiring them. Most law firms simply rely on candidates' law school grades, a series of short interviews and/or a clerkship, and for laterals, reputation and legal work experience. But what if, as part of the hiring decision, law firms objectively and thoroughly assessed their potential hires for their "fit" within the... Posted on October 4, 2009 at 07:26 am by janetmoore

    Marketing is Storytelling

A client sent me this yesterday. It's a single, six-minute shot of a man walking along a road in what looks like Scotland, telling the story behind a brand. This clip is instructive on two levels. First, it's technically really impressive -- the timing is perfect, the delivery is terrific, and it's a masterful work of film making. Equally impressive, however, is the demonstration of the importance of storytelling in marketing. Steve Jobs' presentations are brilliant at this. Too many marketers... Dunbar's Law, Your Brain, and The Limits of Social Media Marketing

Seth Godin just wrote a really interesting post about the size of one's network, or as he refers to it, the "tribe". The magic number, apparently, is 150 and it's known as Dunbar's Law or Dunbar's Number. Dunbar based this number on the processing power of the human brain -- he theorized that we just don't have the brainpower, as a species, to handle a larger number. Here's a quote from Seth's post: Dunbar postulated that the typical human being can only have 150 friends. One hundred fifty... Posted on October 26, 2009 at 09:10 pm by Peter

How to market legal services on Facebook

Facebook is a great place to meet prospects and potential referral sources. With a few clicks, you can find and connect with exactly the kinds of people you're looking for, at no cost whatsoever. The ease with which this can be done, however, too often leads otherwise smart professionals to do things that actually chase prospects away. Lawyers, journalists and trust

As polling samples go, 43 respondents to a survey is not exactly what you'd call statistically significant. So the fact that 43 journalists who cover legal issues gave lawyers poor marks when it comes to explaining the litigation process doesn't prove a great deal. But as Bob Ambrogi at Legal Blog Watch accurately notes, the thrust of the report "rings true" to anyone who has stepped gingerly into the minefield that lies between reporters and lawyers. What's more, not only do journalists... Posted on November 11, 2009 at 09:50 am by Jordan Furlong

Sharing Compelling Email Content on Social Sites Makes Sense

Rather than competing, seems email and social media are complementary tools. According to a recent Marketing Sherpa survey, about 80% of marketers agree that sharing email content on social media sites "extends the reach of email content to new markets," and "increases brand reputation and awareness." So it makes sense to embed social sharing tools within your email marketing campaigns (similar to how the "forward to a friend" option has long been included in emails). See the chart below then... Why You Should Always TYPE the Subject Line for a Law Firm Email Alert or Newsletter (Instead of Copy and Paste)

Let's face it. We are always looking for efficient and quick ways to assemble email marketing campaigns. One of the most common shortcuts is the copy & paste function (good 'ol "ctrl-c" then "ctrl-v"). Why does this happen and what can... Posted on November 2, 2009 at 01:47 am by Christopher Barnes

With each new collaborative technology adopted by the masses - yesterday it was RSS, today it is social media - the pundits have predicted the demise of email as a marketing and communication tool. Syndicated Content “Duplicate”?

I was recently asked if syndicating or licensing content would have a negative impact on the author website's rankings. Was syndicated content seen as duplicate content? The 5 most common mistakes you’ll find on law firm websites

Websites are the single most effective marketing tool for a law firm. Law firms who use their websites effectively are bound to receive referral business from the Internet. For a website to be effective, it has to speak to two separate audiences: search engines and prospects. The higher your site is in search rankings (that is, when it's consistently among the top 20), the more exposure your website will receive. To ignore search engine guidelines for indexing and ranking is to negatively... Posted on November 27, 2006 at 10:26 am by Martin Marzejon

Another law firm sees the blogging light

An article titled "Law Firm's Blog Sets Its Market Tempo" by Micah Buchdahl, recounts how a Delaware law firm comes to a realization that a blog is an important marketing tool. Young Conaway Stargatt & Taylor, a Wilmington, Delaware law firm, launched their Delaware IP Blog in September 2006. Karen Keller, an associate with the firm, understood that a blog is a useful tool in generating buzz for her law firm, "It occurred to me that our practice could offer something unique in the form of a... A new web-based "mock jury" service is currently being offered by TrialJuries. The Web site allows attorneys to submit their cases and have real people decide the case based on the arguments presented. Lawyers are able to try out arguments and evidence and receive detailed information about the jurors' reaction to the case. The cost to submit a case to TrialJuries using text only is $1,500. For audio, the cost is $2,000, and for video it is $2,500. Posted on November 24, 2006 at 09:05 pm by Martin Marzejon

Website Design Should Be Simple, Flexible

The bottom line is this -- the website is now dynamic, not static. A website is NOT like a billboard -- post it once in a high-traffic area and hope the calls pour in. It's not like a Yellow Pages ad -- printed once for the entire year. Not at all. Your website should be updated, changed, tweaked, targeted. You wouldn't send the same newsletter out month after month, neither should your website be considered a once-and-done project. I wore a dark blue suit and a mustard colored shirt -- guess what he was wearing! The implication (in regard to first impressions) was that everyone would think we were not individuals but part of... Cultivating Good Habits

A lot of business development success can be attributed to developing habits that, if applied over the long term, will produce results. Habits like scheduling time for business development and treating that time as sacred as a client commitment or adding a few lines at the end of each e-mail indicating interest in the other person or sharing some of yourself. The challenge is that it's not easy to develop these habits. After all, I've been working at making exercise a habit, rather than a good... Posted on January 14, 2007 at 08:46 pm

Keep the ball in your court

Too often when we market we leave the next step up to the person to whom we are marketing. We say things like "If you meet someone who needs my services, I hope you will keep me in mind" or "If you need help with a matter, please give me a call.". The problem with such an approach: you lose control of the pace and frequency of marketing. The person may or may not keep you in mind. You have left yourself no reason to contact them again. The solution: keep the ball in your court. Say something... Posted on December 28, 2006 at 03:05 pm

Post-Holiday Marketing Blues? During the holiday season, we suggested making a list of your top 5-10 clients, and then making telephone calls to each of them with your holiday wishes. Sure, cards are nice, but personal phone calls are always best. Didn't get that done? With the heavy demands for year-end hours, bills, etc., most lawyers will suggest they simply did not have the time. Those that do make such calls tell me the benefits far outweigh the inconvenience. So...there is no better time... Posted on January 3, 2007 at 11:50 am by Birge

Are you secure? If your law firm is like most, all the pertinent information, from financial records to personal client information to all working documents, is securely stored on the firm's main operating system. While it may be secured, you can bet that it is most likely accessible by anyone with somewhat-technical, bad intentions. In other words, if someone wants it bad enough, they can get it. I received a letter yesterday from my alma mater, alerting me to the fact that the university... Posted on December 15, 2006 at 02:49 pm by Birge

Market Your Inner Circle. Make certain those around you, those you are closest to, know: a) what your practice(s) and expertise areas are; b) what kind of clients, referrals you are looking for; and c) more about your law firm. There are a number of ways people are lured into signing up for Health Maintenance Organizations or HMOs. What? Another Ranking?

As I mentioned in my last post, Dean David Van Zandt of the Northwestern University School of Law came up with his own ranking of law schools based on the number of graduates named to Super Lawyers adjusted to reflect class size (using 1999 enrollment figures). Now Brian Leiter's Law School Report blog takes a crack at it. His ranking is also based on the number of graduates named to Super Lawyers plus some sort of weighted average formula which I frankly don't understand. What both rankings... Does Class Size Matter?

Above the Law reports that Dean Van Zandt of Northwestern Law School believes we should have taken class size into account when ranking law schools. Our rankings are based on a simple count of lawyers selected to 2009 Super Lawyers. The Dean ran his own numbers using a weighted average method based on enrollment in 1999. Using this approach, Northwestern rises from our ranking of 18th to 8th in the nation. Prior to releasing our rankings, we too prepared a test ranking using a weighted average...

Posted on November 19, 2009 at 09:05 am by Tom Kane

Mid-Size Law Firm Videos-Why Online Video Will Convert Visitors

Lawyers who work in a law firm with 5-20 lawyers may think video should not be part of their marketing plan to gain new clients. They'd be 100% wrong. Lawyers fail to look at marketing from a potential client's eyes. Think about why you even have a website: To provide information to online viewers. How do you distinguish yourself from other mid-size lawfirms? With pictures? With flash animation? With your credentials? With your results? That's only fair. As a trade-off, maybe they'll reduce your fee in order to put their name, website and contact info right on your opening sequence, so your online viewer sees your video production company info, and not yours. From this point forward, I will not participate in #FollowFriday #ff on twitter. The original #FollowFriday is commonly shortened to #ff and I've seen other derivatives. You can't just mention as many peeps as you can fit in a tweet and not explain why it is they are being mentioned. Clarify your goals

I often wondered why theories like the law of attraction work. The only explaination I came up with is that we all have a limited ability to focus on ideas. I always have many distractions floating around in my head. Anyway these theories tend to focus our thoughts. Whatever the reason, these theories seem to work most of the time, but not all the time. For example this weekend I wanted to install new air valves on the motor home, set up my reading room and correct some templates for one of my... Posted on September 29, 2009 at 12:28 pm by David W. Google Officially States: “We Don’t Use Meta Keywords When Ranking”

Today Google officially stated they do not use keywords when ranking websites. What does this mean for legal SEO? Not much, actually. We still add keywords for smaller search engines who do still employ META keywords. Furthermore, Google likes to discourage certain habits - like purchasing links - by claiming they have processes in place to rank sites without it. It's not that I doubt they ignore META keywords&#xe2€&#xa6. I just prefer to let someone else be the "early adapter". Posted on September 21, 2009 at 05:42 pm by admin

How to stop foreclosure and modify your mortgage

If you are behind on your mortgage payments, your interest rate is about to adjust, or your mortgage is simply becoming unaffordable, the first thing you need to do is take action.
