    Prematurity Awareness Month

November is Premature Awareness month. Being born early puts children at risk for developing many conditions including cerebral palsy. When a child is born prematurely often their lungs may not be fully developed. This lack of pulmonary maturity can be very dangerous for the child. Often, a delivery may have been prevented / delayed or medications should have been administered to help the child develop more rapidly. Failing to adhere to these standards of care may constitute medical... Posted on November 21, 2009 at 03:10 pm by Robert A. D'Iorio

Cerebral Palsy: Sharing the News of a Child’s CP

I have written in the past of David Sexton's articles in the New York Times pertaining to his son's cerebral palsy. This week David writes about going to a family wedding and discussing his child's condition for the first time with family and friends. As with his stories in the past David writes candidly about his life and the broad spectrum of emotions that he faces as he raises a child with cerebral palsy. Here is a link to the article and to see David Sexton's previous essay's type in "David... Posted on November 19, 2009 at 03:09 pm by Robert A. D'Iorio

Cerebral Palsy Lawyer Obtains $77 Million in Medical Malpractice Lawsuit

Last month a New York Jury delivered a $77 million dollar verdict for a child that suffered a lack of oxygen at birth that allegedly caused the child to develop cerebral palsy. The lawsuit alleged that after noticing signs of fetal distress the doctors and hospital staff attempted a vaginal delivery rather than performing a c-section. According to the lawsuit his delay caused the child to suffer brain damage. Posted on November 17, 2009 at 04:58 pm by Robert A. D'Iorio

    READ THE LABEL

We frequently get calls from people who have experienced medication errors due to pharmacy mistakes. People may be given their right medication - but wrong dose information. or Maybe they received their correct label, but with the wrong medication inside. or Maybe they were given someone else's pills and label! The moral of the story is, pharmacists do make mistakes. They get rushed and don't pay attention to every pill and prescription. This means that you need to read the label each and every... TRACKING TECHNOLOGY AND NURSING HOME PATIENTS

My local paper (The Roanoke Times) ran an Associated Press article yesterday entitled, "Tracking Technology Applies to Patients." The article discussed the development of radio wave beacons and GPS systems to help families and nursing homes know the whereabouts of patients suffering from Alzheimer's Disease. This is great news for a terrible problem. The problem is that as many as 60% of Alzheimer's patients will become "wanders." These patients are physically strong and capable enough to walk... RESEARCH YOUR DOCTOR

I spoke to a lovely woman yesterday about a Medical Malpractice case. Her husband had gone through an unecessary surgery. While on the phone, I looked up the doctor in local Circuit Court records and learned he had been sued 6 times in the last 5 years. Now it is the result of those cases that matter - not the fact they were filed. It appeared he had settled 1 case, 3 had been dismissed and the other two were still pending. Do you want to know if your physician has been sued successfully for... Posted on November 17, 2009 at 02:43 am by Lauren Ellerman

Georgia State Bar Executive Committee Meets in Thomas County, Georgia

As a member of the Executive Committee of the State Bar of Georgia, I am proud that our Executive Committee makes a concerted effort to get outside of Atlanta and meet our fellow Georgia Bar members in the four corners of the state. Last week's meeting in Thomasville, Thomas County, Georgia is a prime example of this. We enjoyed lunch first with many members of the local Thomas County Bar , which is part of the Southern Judicial Circuit. We met at Pebble Hill Plantation in Thomasville, which is... New 2010 Insurance Institute for Highway Safety Top Safety Picks Are Here

The Insurance Institute for Highway Safety's Top Safety Picks for 2010 came out today and for the first time ever, roof strength was tested and included in the ratings. This means the Institute is seriously acknowledging the likelihood of rollover accidents and the survivability of them depending on what type of car you are in. Automobile manufacturers have traditionally tried to ignore roof crush standards, but they really can't now. Especially given the high center of gravity of an SUV, that... New York gets a new blogger, doing his thing at Lou and The Law. Lou has been an occasional commenter here, and comes from the defense side of the aisle having worked as senior trial attorney for Liberty Mutual Insurance for almost 30 years. Worth reading for New York practitioners is Late Expert Disclosure Affidavits, and it is worth it because the statute governing expert affidavits doesn't actually have a time frame in it. Outsourcing Marketing = Outsourcing Ethics (5 Problems With Outsourcing Attorney Marketing)

Five months back there was a Metro train crash in Washington DC, and I watched from a distance to see who/how/where/when the web would be used by lawyers to find victims. And one of the things we saw was that one of the gazillion attorney search firms that infect the web was soliciting clients. Given that these search firms are agents of the lawyers, that raised the problem of attorneys using the web to solicit. Thus was born this little formula in June: outsourcing marketing = outsourcing... Posted on November 15, 2009 at 10:00 pm by Eric Turkewitz

New Website Lets Consumers Track Illinois Hospitals

Illinois consumers can now pore over an abundant amount of data, mostly much of it unpublished, about Illinois hospitals and surgery centers on a state-sponsored Web site. Medical Malpractice Reform Can Have an Unhealthy Impact

Tort reform proponents assert that medical malpractice costs are a significant factor in rising health care costs, yet they are clearly wrong. Medical malpractice premiums account for only a tiny fraction of our medical bills and have not risen the way that health care costs have. Also, tort reform advocates tend to disparage the performance of the jury system. Usually juries only compensate patients who are true victims of medical malpractice. Advocates also forget that the right to a jury is... Posted on November 18, 2009 at 07:29 pm by Levin & Perconti

Is blaming lawyers the new "strategy" for halting any meaningful health reform?

CNN.com recently featured an Op-Ed by Anthony Tarricone, the president of the American Association for Justice. The interesting Op-Ed highlighted the recent uptick in "lawyer blaming" that opponents of health care reform are using. Mr. Tarricone summarized it quite nicely when he wrote, "Somehow, the fringes of the GOP have made health care about trial lawyers and medical malpractice. However, even we have to admit that this particular hospital has taken its fondness for wrong site injuries, a tad far. The Associated Press is reporting that a hospital in Rhode Island has been fined $150,000, and been ordered to install video cameras in all its operating rooms, after the 5th wrong site surgery in its facility since 2007. Rhode Island Hospital is the largest hospital in the state,... Posted on November 6, 2009 at 11:40 am by Theodoros & Rooth

A Lackawanna County jury found that a urologist violated the standard of care in his treatment of a 54 year old man who complained of urinary problems. Terrence Golden began seeking Dr. Milan Smolko in September, 2002 and ultimately treated with him several times over 16 months without any diagnosis of resolution of his problems. Man Speaks After 6 Year Coma

An MSNBC.com article outlines a recently successful procedure to bring a man out of a six-year coma. At his family's request, the man remains anonymous. The changes in his mental state, however, are for the world to know. "My son can now eat, speak, watch a movie without falling asleep," explained his mother. "He can drink from a cup. He can express pain. He can cry and he can laugh." This had not been the case for the last six years, a time when the man was fed though a tube, rarely showed... Posted on August 2, 2007 at 01:01 pm

    What is Spinal Cord Injury?

Spinal Cord Injury (SCI) is damage to the spinal cord that results in a loss of function such as mobility or feeling. Frequent causes of damage are trauma (car accident, gunshot, falls, etc.) or disease (polio, spina bifida, Friedreich's Ataxia, etc.). The spinal cord does not have to be severed in order for a loss of functioning to occur. In fact, in most people with SCI, the spinal cord is intact, but the damage to it results in loss of functioning. SCI is very different from back injuries... Posted on June 25, 2007 at 11:54 am

    Pain in the Brain?

A recent study published by Northwestern University researchers and reported by Science Daily may reveal new answers about chronic pain. An estimated 10% of the United States' population suffers from a chronic pain; thus, these findings may help improve the daily lives of millions of individuals. Instead of focusing on the area where the pain is felt-as most doctors and researchers have in the past-the new findings reveal the pain we feel may be rooted in the brain. That is, our repeated... Over the years we have successfully prosecuted federal tort claims involving cancer of the breast, lung, prostate, colon, kidney, brain, and many others. An issue that comes up in each case is how much damage was caused by the failure to timely diagnose the malignancy? Unlike a surgical or medication error which is directly caused by a... An 18-month old child suffered a severe brain injury when her breathing tube became dislodged while she was under sedation for an MRI. To this day, many front line physicians do not know of the long-standing guidelines setting forth that some patients at risk for stroke who are chronically anticoagulated with coumadin should receive lovenox as a bridging therapy to prevent a recurrent thromboembolism. As such, many patients suffer devastating strokes as a result. Some of these people, unfortunately end up as plaintiffs in medical malpractice cases. One of the most critical aspects of a birth injury lawsuit involves the estimation of the brain injured child's future care needs. The life care plan is a tool that's assembled by a physician, nurse and economist along with your attorney that specifically identifies all of the future care needs of the injured child. The life care plan includes an opinion regarding the child's attendant care needs eg: how many hours per day and whether an RN, LVN or medical assisant is necessary; estimations of... A common method of preserving a minor's assets is to allocate a significant portion of the settlement to the purchase of an annuity (See: July 29, 2008 Blog Entry) and to direct the monthly annuity payments into a special needs trust. If you were hiring an accountant would you want him to be an SOB? Would you want an SOB for a son-in-law or a spouse? How about for a doctor? What is an SOB? A new Pew survey shows that the problem may be worse then we believe. The researchers surveyed 800 teens between the ages of 12 and 17 between June and September this year. Seventy four additional teens, who were part of 9 focus groups in New York, Atlanta, Denver and Anna Arbor were also surveyed. While some of the results... Posted on November 19, 2009 at 01:21 am

Wolf Hybrid Dogs: Loving Pets or Threats to Kids?

/**/ I recently came across this article in the Telegraph about the growing numbers of families in the UK choosing to rear wolf dog breeds. Veterinary experts in the country are warning that this growing number of wolf dog hybrids could be a danger, especially to children who are looked upon as prey by these breeds. In fact, according to representatives of the Royal Society for the Prevention of Cruelty of Animals, these wolf dog hybrids may be likely to express their naturally wild behaviors... Syracuse Medical Malpractice Lawyers On Revised Cancer Screening Guidelines

Recently, the American College of Obstetricians and Gynecologists announced that women can forego cervical cancer screening until they are 21 years of age and, even then, only need screening every 2-3 years. Previously, the standard of care required Pap testing within three years after a woman started having vaginal intercourse in order to check for pre-cancerous cells within the cervix. Many criticize the change in screening protocol. Some suggest that it will encourage failures to diagnose... Posted on November 20, 2009 at 06:58 pm by Bottar Leone, PLLC

Failures To Diagnose Breast Cancer May Increase Following Task Force Recommendations

Syracuse radiologist, Stephen Montgomery, M.D., who is also the medical director for Crouse Hospital Breast Health Center, believes that recent Task Force recommendations about mammograms -- imaging studies used to detect breast cancer -- are "complicated." Earlier this week, the U.S. Preventive Service Task Force recommended that women over age 50 undergo mammograms every-other-year. It also recommended against breast self-examinations. Why HP and Lawyers Don’t Mix

The simple answer is: lawyers actually have work to do. Often, that is why they buy computers. Therefore, lawyers who want to get work done must buy computers that work. The logic is simple. But of course, even the best products break now and again. That's why there are repair people, and in the world of computers, tech service workers, a special breed of customer service employees, who are supposed to help resolve your problem. It is often at this juncture, when the computer customer has a... Posted on November 20, 2009 at 09:50 am by Andrew Barovick

Insufficient Evidence Leads to Dismissal of Prostitution Charges

According to a baltimoresun.com article, prostitution charges have been dropped against a man from Patterson Park, Maryland due to insufficient evidence. Apparently, two women accused of being prostitutes refused to testify against the defendant. Since no other witnesses were available, and due to additional information and evidence not being strong enough to stand on its own without witness testimony, the charges were dropped. Chiropractic Stroke: Tests At Chiropractor's Office May Be Ineffective

The fact that neck manipulation can cause strokes among chiropractic patients is not commonly known. Chiropractors would like to keep it that way. However, a study conducted by the Stanford Stroke Center in 1992 sought to answer how common strokes caused by neck manipulation are. The Stanford study focused on 486 doctors associated with the American Academy of Neurology in California. 177 of the 486 neurologists polled claimed they had treated patients that had suffered a stroke after receiving... In fact, Indiana has one of the most stringent medical malpractice laws in the nation. Indiana patient's injured as a result of a doctor's negligence are... A recent report released by Thomson-Reuters indicates that a staggering $800 billion is wasted every year in the U.S. health care system due to inefficiency, fraud, medical mistakes and lack of preventative care. Child Loses Finger in Stroller - Injury Forces Recall

British stroller maker Maclaren failed to inform government regulators for 5 years about the danger of its strollers. The company has known for some time that the stroller hinges could cause serious injuries to the fingers of children. In 2004, 23-month-old Connecticut toddler Carlos DeWinter lost his right pinky in a Maclaren Triumph stroller, according to court papers obtained by The New York Post. As his mother, Jane DeWinter, was shopping for a Maclaren Triumph stroller at a shop near... Posted on November 14, 2009 at 09:00 pm

Infants Injured by Maclaren Strollers - Fingers Amputated

According to recent press reports, the British stroller maker Maclaren knew for at least 5 years that its strollers could cut the tips off --- or completely amputate --- a child's fingers, but did nothing to alert the federal watchdog Consumer Products Safety Commission until very recently. Conceding that the fingers of 12 children have been severed by the stroller's hinges when they were opened or closed, Maclaren agreed to a "voluntary recall" of all of its stroller models dating back to... Preventing Injury --- No Sponge Should be Left Behind

It's the entire hospital's responsibility&#xe2€&#xa6and particularly the operating room team handling surgeries routinely&#xe2€&#xa6to ensure that foreign objects are not left inside of patients after surgery. Yes, it does occur. It's rare, but leaving a sponge inside a patient after an operation is one of those errors that simply should not happen. A hospital should regularly review its surgical count policy to ensure that everyone on the OR team accepts responsibility for preventing retained foreign objects.... Professional Football and Brain Injury

There have been many reports in the news lately about links between playing professional football and early onset of dementia. Now, according to a story in the San Francisco Chronicle, Congress is investigating. All this recent attention started with a New Yorker Magazine piece about the high number of pro football players with dementia, often misdiagnosed as Altzheimer's. None of these reports will come as much of a surprise to personal injury lawyers who have handled traumatic brain injury... Posted on November 13, 2009 at 11:26 am by Callaway & Wolf

Remarkable $16.5 million Wrongful Death Verdict - Sacramento radio station contest

Wrongful Death verdicts and settlements in the San Francisco Bay area and throughout the state have gone up a lot in recent years. This is one of the very few areas where juries seem to be more generous today than they were ten years ago. A recent verdict against a radio station in Sacramento, California makes this point. As reported in a CBS news story, one of the participants in station KDND's contest, entitled "Hold your Wee for a WII," Jennifer Strange, died from water intoxication after... Why are San Francisco streets so dangerous for pedestrians?

A recent column in the San Francisco Chronicle cited a chilling statistic: a full 50% of the traffic fatalities in the city involve pedestrians. This compares with an average of 15-20%. This far from the first report about how dangerous our streets are for pedestrians. According to a U.S. National Highway Traffic Safety Administration (NHTSA) study, SF is the 4th most dangerous city for pedestrians per capita (among U.S. cities with populations of 500,000 or more). Medical Malpractice And Tort Reform: Enough Already

Joanne Doroshow wrote an excellent article in the Monday, November 9, 2009 edition of The Huffington Post called Medical Malpractice Tort Reform - We Are Already Suffering And Don't Need More. She points out that unless you are currently living under a rock you have heard the term "tort reform" but, sadly, probably don't know what it really means. In Illinois we have tort reform as it relates to medical malpractice. Starting in 1985, and every ten years thereafter, the state legislature has... Posted on November 12, 2009 at 08:27 am by Ian R. EVIDENCE OF DISCOUNTED BILLS ADMISSIBLE TO DETERMINE “REASONABLE VALUE” OF MEDICAL SERVICES IN INDIANA PERSONAL INJURY CASES

In Stanley v. Walker, the two parties were involved in a car accident and the plaintiff filed a negligence complaint. The defendant asked the trial court to admit evidence that the plaintiff's healthcare providers discounted the medical bill. The plaintiff objected, arguing that any evidence of write offs would violate Indiana's collateral source statute, Ind. Code &#xc2&#xa7 34-44-1-2.
