New Federal Legislation Makes Receiverships Less Risky As A Collection Tool
The Protecting Tenants at Foreclosure Act, which went into effect on May 20, 2009, was designed to provide protections for tenants in the event of foreclosure. In the past, tenants had little or no right to retain their lease when their landlord lost the unit through foreclosure. The new law affords a greater notice period for eviction (increased to 90 days) and allows renters to stay for the remaining term of their lease except in the event that the new title holder intends to occupy the unit... New FHA Guideline Implementation Delayed Again
The FHA announced yesterday that it is once again delaying the implementation of the requirements found in Mortgagee Letter 2009-19 until December 7, 2009. As we posted previously, these new guidelines for condominium projects are likely to have a significant impact on condominium communities. FHA has indicated that revisions to the 2009-19 Letter will be forthcoming in the next two weeks and will offer leniencies because of current market conditions and provide clarification to some of the... Colorado Supreme Court Rules Titles Obtained Through Adverse Possession Subject to Terms of the Association Declaration
The Colorado Supreme Court recently issued a ruling in B.B. & C. Partnership v. Edelweiss Condominium Association, holding that a party taking title to real property through adverse possession cannot do so free and clear of the restrictions in a recorded condominium declaration. The party at issue was an original member of BB&C, the declarant, and thereafter the association's managing agent for 20 years. BB&C acquired title to an association parking space by adverse possession, and... Posted on October 16, 2009 at 02:02 pm

Two Judges Refuse to Seal the Record in Toyota Document Discovery Abuse Case
As a follow-up to my September 4, 2009 blog entitled, "Toyota Rollover Lawsuits: Automaker's Former Attorney Accuses Auto Manufacturer of Concealing Evidence in Over 300 Auto Products Liability Cases," U.S. District Judge George H. King, the judge presently assigned to the case, refused to grant Toyota's request to seal the lawsuit in the face of Toyota allegaions that Toyota will suffer "further harm" if the complaint is not sealed. Seat Belt Syndrome: Child Safety Continues to Take a Back Seat
More needs to be done to prove child safety when it comes to seat belts-especially as not all US states require that kids ages 4-8 use booster seats. Unfortunately most seat belts are unable to properly fit over the bodies of many children to ensure maximum protection, which can result in catastrophic seat belt-related injuries, known as seat belt syndrome, during a car accident. Just last year, one 7-year-old's life changed forever when she sustained seat belt-related injuries during a... Posted on November 14, 2009 at 03:40 pm by Gilbert, Ollanik, & Komyatte, P.C.

Should I talk to my doctor before applying for Social Security disability benefits?
If you have a long-standing history with your doctor, it is often a good idea to speak with your doctor early on during the Social Security disability application process. Here are some things you should discuss: Let your doctor know that you are applying for Social Security disability benefits. Ask your doctor if he or she feels that you are disabled? Under Social Security regulations low birth weight babies may qualify for Social Security disability (Supplemental Security Income - SSI) benefits. It is important to note that Social Security does not specifically consider whether the child is premature or not. Social Security considers the birth weight of the child: "Low birth weight" is defined as a birth weight under 1,200 grams (2 pounds 10 ounces) or under 2,000 grams and small for gestational age. Workplace Privacy and the 4th Amendment
The 10th Circuit Court of Appeals issued an opinion last week, United States v. Barrows, that should a.) remind you to stay away from child pornography and; b.) convince you that your privacy rights in the workplace are more limited than you might think. While not strictly an employment law case, readers should remember that their Constitutional rights generally don't extend to the workplace, especially if they work for a private employer, and won't always protect them if they work for a public... New Colorado Wage Order Issued
The Colorado Department of Labor and Employment issued Wage Order 23 yesterday, April 1st (no joke). The new wage order comes after Coloradans voted last year to increase the minimum wage to $6.85. Although the new wage went into effect January 1st, the law that increased the minimum wage was a bit vague on some details, like wages for unemancipated minors. Essentially, however, the Minimum Wage Order 23 is identical to Minimum Wage Order 22. Don't forget to post the new minimum wage order,... Posted on April 2, 2007 at 05:17 am by Peter Mullison -

When Employers Can be Held Liable for their Employees’ Crimes
Katrina Campbell Randolph over at The Recorder has an article that employers will want to spend some time reading. As Randolph reminds us, just as employers can be held civilly liable for the employee, it can also be held liable for the criminal acts of its employees that are done in the scope of their employment. Randolph's article is a quick primer on the Federal Sentencing Guidelines for Organizations. Under the guidelines, an employer must "must proactively take steps to ensure that even... Under Colorado divorce law, the parties will sometimes enter into a written separation agreement that sets forth the terms of the divorce including those related to spousal maintenance, parenting time and parental responsibilities, child support, and disposition of property. Many issues arise when a service member and his or her spouse decide to get a divorce. The military spouse's continuing eligibility for commissary, exchange and health care benefits, as well as his or her eligibility for a portion of the servicemember's military retired pay are a large concern. The Uniform Services Former Spouses' Protection Act (USFPA) addresses these concerns. The USFPA does not automatically give a former spouse any of the member's retired pay. Mortgage Cram Downs in Bankruptcy
Do your part to help save homes across America As you are aware, homeowners across America continue to suffer from mortgages that are under water. An example of an underwater mortgage is: Home is appraised at $300,000 but $500,000 is owed on the first mortgage and $100,000 is owed on the second. If the bank repossessed the home, the most they could sell the house for would be $300,000. In fact, they would receive substantially less because they would absorb the cost of selling the property.... Posted on November 21, 2009 at 07:47 pm by admin -

In the tax realm, there seems to be an abundance of websites and paid consultants to "help" the misguided taxpayer. Here are our top five frivolous tax arguments guaranteed to get you in hot water with the IRS: 1. Filing and Paying Income Tax is Voluntary: The argument goes that the IRS itself, even in its own publications, states that... Posted on September 28, 2009 at 03:20 pm by admin0 -

Will I have to pay tax if I lose my home in a foreclosure?
Every mortgage loan has two parts, a note and a deed of trust. The note is your debt to the mortgage company. The deed of trust is the document secures the debt with your home. If you get behind on your payments, the mortgage company may foreclose on your home and sell it at an auction. The difference between your loan amount and what the mortgage company sold it for can create a deficiency. (For example, if you have a $300,000 mortgage loan and the house sells for $200,000 at a foreclosure... Posted on January 30, 2009 at 09:24 pm by admin0 -

How does $56.4 billion sound?
The IRS recently released its annual enforcement figures for its 2008 fiscal year. The bottom line-$56.4 billion in enforcement revenue collected. Collecting the billions required the IRS to issue over 2.6 million tax levies (IRS garnishments and bank levies) and 750,000 tax liens on taxpayers' property. Many of these levies and liens occurred after taxpayers failed to file their tax returns or pay tax. Tax levies and lien normally occur after numerous notices from the IRS. Taxpayers can stop... Restraining Order vs. No Contact Order
By Bridgette D. Kaczmarek, Senior Associate Kaczmarek Law Firm If you have read one of my other blogs, "A Package Deal," you would know that many divorce cases come with several cases wrapped into one - domestic violence case, restraining order and then the divorce action. This article focuses on Restraining Orders. I normally advised clients to obtain a restraining order when they are concerned about harassment or threats of violence from their spouse. The restraining order can include the... Posted on August 27, 2009 at 02:48 pm by Gasper Law Group -

Defining a WIN in Divorce - "It's the Kids, Stupid!"
By Bridgette D. Kaczmarek Senior Family Law Attorney The Gasper Law Group When I was asked by our Office Manager to do a blog about what is considered a "win" in a family law case, I had to chuckle to myself. You see, just a couple of hours earlier, I was engaged in a long conversation with one of the Judges next door about that exact topic. The judge and I were discussing what would constitute a "win." She and I both concurred that, in a divorce case, there are no winners. If anything,... Posted on August 10, 2009 at 07:48 am by Gasper Law Group -

Filing for Divorce - "Race To The Finish"
By Bridgette D. Kaczmarek Senior Associate Attorney - Domestic Relations The Gasper Law Group I have had clients come in and ask whether it is better for them to file a Petition for Dissolution first. Client frequently believe that it is important to be the first to file. When asked what position is better, I always answer, "It depends." If a party is having an extra-marital affair, is it better to file first and go on the offense to dispute the claim? If one party feels they can no longer... Boot Camp - Potential for Sentence Reconsideration
Allen Gasper is the Senior Partner in the Gasper Law Group, Colorado Springs. In considering potential plea offers in District Court cases in Colorado, a question arises about the possibility of reconsideration of sentence in the future and the best approach to establishing a "track record" for the court to consider in determining whether the defendant is a good candidate for reconsideration of sentence. Boot Camp provides a vehicle for proving a defendant's acceptance of responsibility and... Posted on August 25, 2009 at 04:47 pm by Gasper Law Group -

Criminal Defense Investigator - Key to Criminal Defense
By Mark C. Cohrs Senior Investigator for The Gasper Law Group A necessary part of providing legal representation to defendants charged with a criminal offense is the task of evaluating the evidence against the client. The Constitutional concept of "innocent until proven guilty" is not always a reality when a person is accused of committing a crime. Oftentimes, even well intended officers who are dispatched to investigate alleged offenses tend to react primarily on the basis of probable cause,... Attorney: "Why don't we go into my office to discuss this some more?" Misconceptions abound about the use-and potential misuse-of handwriting analysis in order to prove or demonstrate a particular point in the courtroom. Colorado Fall School Registration for Children in Multiple Homes
August is Colorado's month to register children for school. It is a good time to review your Parenting Plan and decision making to see which parent, or if both parents, are to decide which school the children should attend and who is to register the children. If one parent has "sole decision making" regarding the education of the children, then it is usually that parent who is expected to decide which school the children should attend, and then register the children. When the parents share... Posted on August 4, 2009 at 01:06 pm by Carrie L. Chaille -

Domestic Adoptions in Colorado
If you are located in Colorado and looking into adopting a child, I offer my assistance in initiating domestic and international adoptions. When you are adopting a domestic child, there are several options. You may attempt to "Foster to Adopt" through the state. Or, you may choose to adopt privately, which means that you find the birth mother and adopt her child. The other option is that you go through an agency/program adoption, where the agency helps you locate and match you with a birth... Posted on July 14, 2009 at 01:30 pm by Carrie L. Chaille

Divorce, Mediation and Fairness: A Potential Client's Inquiry
/**/ A potential client (we'll call her Ms. Smith) asked an important question this morning: "My husband has just told me that he is seeking a divorce. We plan to use mediation if possible. I have concerns about whether mediation addresses fairness?" My reply follows: Ms. Smith: Thank you for your very important question about the divorce process, mediation and fairness! Empathy, Anger & Sorrow (Erasing the Lines in the Sand)
In discussing disappointment's natural place in the landscape of life, psychotherapist Michael Miller, Ph.D., recently wrote in a popular magazine's feature article: Empathy helps turn anger into sorrow. When sorrow becomes mutual, it begins to erase the lines drawn in the sand. I recognize this as a common phenomenon in divorce and family mediation. A divorcing couple struggles mightily with their difference of views and their anger with each other in the mediation session is pervasive. At... Posted on April 23, 2006 at 09:01 am by Larry -
