Peanut Butter Recalled For Salmonella Contamination
King Nut Companies recently announced a recall of peanut butter distributed under the King Nut label, made for the company by Peanut Corporation of America (PCA). The recall was issued after salmonella was discovered in an open five-pound tub of King Nut peanut butter. The products are not sold directly to consumers; they are distributed through food services accounts to hospitals, prisons and more. The FDA, CDC and health departments in Minnesota and Connecticut, have now confirmed that the... Posted on February 1, 2009 at 05:13 am -

Four Dead in Pickup Truck Accident Carrying Illegal Immigrants
A pickup truck crashed Sunday morning, April 27, killing four of its passengers. The vehicle was carrying as many as 60 people when it rolled over in a remote part of Arizona. Investigators believe that the people in the pickup truck were illegal immigrants. The truck was driving from 50 to 60 people and 20 to 30 people fled the scene of the accident into the desert. So far none of the passengers who fled have been found. So far there have not been any arrests made, but police officers are... Posted on April 27, 2008 at 07:22 pm

Advice for Car Accident Victims Injured by a Driver Using a Cell Phone
There have been an ever-increasing number of studies highlighting the dangers of using cell phones while driving. Talking on the phone while driving is bad enough, but texting can actually be far worse because drivers are forced to take their eyes off the road and the cars around them in order to type their message. This type of behavior is one of the most obvious forms of negligence there is on the roadways. Many issues come to the forefront - issues that wouldn't have otherwise existed - when... What if I Admit to Not Wearing a Seatbelt? Can I Still File a Personal Injury Claim in Arizona?
Yes, you can still file a personal injury claim even if you weren't wearing your seatbelt, but it's just harder to receive full compensation for your injuries and any expenses related to the accident if you weren't wearing a seatbelt. That's because the at fault driver will absolutely use the fact that you weren't wearing a seatbelt against you. Their insurance company will most likely hire expert witnesses in order to gather evidence that proves that had you been wearing a seatbelt, you... Construction Workers Injured Due to Roof or Stair Collapse Are Often Entitled to Retain Arizona Personal Injury Attorneys in Addition to Workers Compensation Claims
Structural collapse causes a number of Arizona construction accidents resulting in catastrophic injuries and even wrongful death. According to a news report, a roof collapsed at a school construction work site sending two workers to the hospital with injuries. The school was apparently undergoing a two-story addition and about 10 construction workers were on the job when the accident occurred. Workers were reportedly cutting the first floor. The front wall of the building basically pitched out... Posted on November 19, 2009 at 06:00 am by Breyer Law Offices -

Experienced Arizona Construction Injury Lawyers Help in Cases Where OSHA Investigates Fatal Construction Accidents
A number of Phoenix construction accidents are entirely preventable. The Occupational Safety and Health Administration (OSHA) requires all employers, including construction companies, to institute state and federal mandated safety standard specifically in order to prevent tragic accidents that commonly occur at construction sites in Arizona and elsewhere in the nation. However, not all companies follow these safety standards. As a result, construction site accidents continue to cause injuries... Posted on November 17, 2009 at 06:00 am by Breyer Law Offices -

How Can a Construction Accident Worker Injured in a Fall Find a Construction Accident Lawyer?
Falls are the leading cause of fatalities in the construction industry in Arizona and the rest of the country. According to the U.S. Department of Labor, an average of 362 deaths occurred as a result of falls each year from 1995 to 1999, a trend that is apparently increasing. A number of construction site falls occur because workers do not use proper harnesses as required by federal law. Here is an example of a fatal fall at a construction site where a worker fell 125 feet and died after a tall... Posted on November 12, 2009 at 07:00 am by Breyer Law Offices

Arizona Extreme DUI: The Out of State Visitor Dilemma
The harsh penalties for an Arizona extreme DUI conviction have been well chronicled in this blog. However, what happens when we apply these penalties to people who were only visiting Arizona and charged with DUI? One could take the view: who cares? When people come to "our state" and commit crimes, they deserve whatever they get. On the other hand, you could look at what I believe are the unintended effects of these penalties on visitors to Arizona. Moreover, these unintended consequences... How accurate is blood testing for alcohol?
The truth of the matter is we don't really know. Most labs in the Phoenix Arizona area claim to be accurate within 5%. That means if your blood result came back at .08, then the true result can be anywhere from 5% lower or 5% higher. Other scientific organizations claim 5% is not a realistic range of accuracy. For example, the American Academy of Forensic Sciences claims that the accepted range of accuracy is 10% higher or lower. After interviewing toxicologists over 100 times, doing a... No Consent, No Warrant, No Blood
Some things in life seem obvious. It is hotter in the summer. It is colder in the winter. The government must get a warrant to stick a needle in your arm before they forcibly take your blood. However, this last presumption has not been so obvious in Arizona. For years in Arizona, attorneys have been arguing that law enforcement must get a warrant before taking your blood during a DUI investigation. Unless, of course, the person "expressly consents" to the blood draw. However, many Arizona... Posted on September 4, 2009 at 07:03 am

More on Smoking Bans
This post is a response to the multiple, thoughtful comments on my post yesterday. As I began to write, it got too long and I decided make it a different post altogether. Here are some additional thoughts on smoking bans: I don't think that cigars in general will be regulated out of existence; Swisher Sweets and other mass-produced, mass-marketed products aren't going anywhere. The cigars I like though, generally made by smaller operations in unpopulated or largely undeveloped places focusing... Posted on November 18, 2009 at 06:17 am by Matt Brown -

Banning Good Taste
Given my predilection for the occasional stogie, I've considered writing something like this for quite some time. Although the The Stogie Guys beat me to it, strangely, I'm inspired to post something along similar lines. The weather in the Phoenix area right now lends itself perfectly to an evening cigar. I can think of few greater pleasures in life than sitting on my back porch with good company and savoring a delicious, handmade cigar. I've had a few nights like that these past few weeks. For... I tried to get through my 1:00 p.m. meeting on Thursday early enough to catch some of the most recent contempt proceedings in this case. You can get additional information about what's going on here, here, here, here, and here, but I'll give you a single, run-on-sentence summary of what people are reporting happened: one of Maricopa County Sheriff Joe Arpaio's goons brazenly looked through a defense attorney's privileged and confidential file during a video-taped sentencing, committed... Nonprofit Law Jargon Buster – Private Inurement v. Private Benefit
The private inurement rule and private benefit rules exist to ensure that charitable assets are preserved for the benefit of the public and not diverted to private use. This is a fundamental concept that distinguishes tax-exempt organizations from for-profits. The rules originate in the language of Code Section 501(c)(3). Code Section 501(c)(3) contains the specific requirement that: [N]o part of the net earnings of [the exempt organization] inures to the benefit of any private shareholder or... The Long Arm of Charitable Solicitation Law
Thirty-eight U.S. states as well as the District of Columbia and many local jurisdictions require some type of registration for charities trying to solicit funds. From the National Highway Traffic Safety Administration comes a Q&A about Blood Alcohol Concentration. Q: Does the type of alcohol I drink affect my BAC? A: No! A drink is a drink, is a drink. This is the approximate amount of alcohol found in: one shot of distilled spirits, or one 5-ounce glass of wine, or one 12-ounce beer. Q: What affects my BAC? From Msn money, President Barack Obama has signed legislation extending the $8,000 first-time-homebuyer tax credit beyond its scheduled Nov. 30 expiration and creating a $6,500 credit for longtime homeowners who buy new homes. Altanta DUI Attorney Richard Lawson wins difficult trial
I am happy to report the good news that Atlanta DUI attorney Richard Lawson won a not-guilty verdict in a Cherokee County DUI trial on a case that many Georgia DUI lawyers would have advised their clients was impossible to win. Do You Own a Business or a Job?
You have set up a corporation, designed a stunning logo, and registered your trade name. You have opened a bank account in the name of your company, rented office space, and begun wooing clients. You're a business owner, right? Not necessarily. Many people -- perhaps even most -- who consider themselves business owners don't really own a business, they own a job. High Tech Porn Can Mean High Tech Trouble
Law enforcement and prosecutors hear this defense all the time: "it wasn't me." If you went and visited a state prison, you would probably hear a lot of people behind bars say "it wasn't me." Let's face it: a lot of people will not own up to a crime that they have committed. Thus, when you hear someone say "it wasn't me," your natural assumption is that the person is lying. Drug use seems to be a never-ending problem in Arizona. As a result, we have a never ending amount of people becoming criminals. If you were sitting in one of Arizona's courts devoted solely to the resolution of drugs cases, the lines would resemble those at Costco or Sam's club. Arizona "No Fault" Divorce
Many people often ask what an Arizona "No Fault" Divorce really means. In simple terms, it means that in Arizona any husand or wife, despite what the other spouse may want, can get divorced without the other agreeing that the marriage should be disolved. The Arizona divorce statute requires that there must be an "irretrievable breakdown" of the marriage for the court to be able grant a divorce, or as it is technically called, a dissolution of marriage. If either a husband or wife by petition... Posted on October 25, 2009 at 02:58 pm -

Now That I've Filed a Chapter 7 Bankruptcy, What Should I Expect to Happen?
Well, the first thing you should expect is some small amount of peace and quiet. Prior to the filing, you may have been getting a few love notes from creditors in the mail, or by way of their process servers, and phone calls telling you that your creditors miss their payments, deeply. That will stop rather abruptly, because when you file your creditors will get notification of the filing and the effect of the automatic stay of 11 USC 362, and they will stop. Automatically. We are a very small sports fitness company. We train clients at our gym. We also market a product on eBay that we manufacture. We call this product a Resistance Trainer. We use it at our gym, too. It's a very safe and inexpensive product that uses your body weight as resistance for a wide range of exercises. The military, for example, uses similar training. We market our product in our gym and on Ebay. Recently, we received an email from a company that purchased our product and said it was in... Posted on March 27, 2009 at 01:45 pm by Andrew P. Counterfeit Tiffany Ring on eBay?
I just listed a Tiffany ring on eBay. I originally received the gift as a Christmas present. Tiffany's lawyers say the ring is fake. The sent me a letter demanding $450, a letter from my lawyer and the ring. I am not sure if this is a fake Tiffany ring. I thought it was a real ring. First, you are going to need to know whether or not this is a real Tiffany & Co. ring. It is possible that you may not be able to figure this out on your own. You may need an appraiser or another expert's help... Posted on March 22, 2009 at 01:25 pm by Andrew P. Lahser, Scottsdale Trademark Attorney

Taxpayer Indicted in Florida for Selling "Tax Escape Service"
Carel A. Prater, also known as Chad Prater, was indicted by a Florida Grand Jury a few weeks ago. The charges were based on Mr. Prater's business which was built apparently around the notion that income is not taxable. He would in support of this, prepare false tax returns and bogus documents for his clients, tell them to conceal assets and income from the IRS by setting up "shell limited liability companies" and "unincorporated business trust organizations", and by transferring ownership of... Koko Taylor Loses Her Offer In Compromise Challenge in Tax Court
Many reading this entry are likely wondering who "Koko Taylor" is. at least those who don't follow "Blues" singers. To tell the truth, I didn't know either until I read this forbes article. Apparently, Koko Taylor is a blues singer who has won at least one Grammy as well as 25 "Blues Music Awards." In the 90s, she had some good years income wise, and just didn't withhold enough income tax resulting in a rather large tax debt. She is now about 80 years old and you'll probably agree that, her... Serious IRS Debt in Arizona - Disadvantages of Using Bankruptcy
Should bankruptcy be considered a last resort in dealing with IRS debt? In my opinion, yes. It should however, always be carefully considered. The potential benefits of a bankruptcy can be undeniable in relation to a taxpayer's potentially less effective options. Having said that, bankruptcy does have some obvious negatives for the taxpayer with serious income tax debt. The more common are as follows: 1. Bankruptcy Costs Money There is the attorney who is analyzing your case and representing... Posted on February 11, 2009 at 03:48 pm by Michael S. Anderson

The Top 25 Legal Movies?
There's a diverting post over at the ABA Journal headlined 'The 25 Greatest Legal Movies'. Pleasingly, a number of Blade's favourite films make the cut, including classics such as The Verdict, Twelve Angry Men and, in first place, To Kill A Mockingbird. Scandalously, however, the panel of judges did not include The Trial, directed by Orson Welles in 1962. What's wrong with our learned friends across the Atlantic? Surely they've heard of Messrs Welles & Kafka? Posted on July 23, 2008 at 12:17 pm by admin -

When YouTube is misused
Here's a cautionary tale. The Times reports today that Judge Harold Beeler has granted millionaire Philip Smith, 76, a divorce from Tricia Walsh-Smith, who wrote the play Bonkers, on the ground of cruel and inhuman treatment. As the paper puts it, "The judge voiced scorn for Ms Walsh-Smith's effort to embarrass her husband by posting video diatribes on YouTube that were viewed by more than three million people." Indeed, the video postings were "a key reason" for the judge's decision to grant Mr... Posted on July 23, 2008 at 11:13 am by admin -

Fresh woe for eco-towns
Following Swordplay's recent post about apparent flaws in the government's eco-towns initiative, the FT reports today on additional planning law issues which have been brought to light in an opinion by John Steel QC and James Strachan. The government approach "would be promoting a policy and process which would be inherently flawed," say the barristers in their opinion, which concludes that there would be "sound grounds" for a local authority to seek a judicial review. The eco-town appears,... Posted on July 23, 2008 at 10:56 am by admin
