More sad new items on dangerous dogs...

The increasing (mis)use of dogs as weapons is apparently a global problem. As columnist India Knight reports in the Sunday London Times: "The teen gangster's new weapon of choice: a snarling dog." Here in the U.S., a particularly sad ending on Friday for Oreo, the pit bull mix (shown at right). Oreo was rescued by the ASPCA in New York City this past summer, after her former owner beat and threw her off a six-story roof in Brooklyn. Doctors repaired her physical injuries, but it seems that even... Posted on November 15, 2009 at 04:10 am by Amy A. Breyer

Is Obama Ready to Take on Factory Farming?

In 2008, Barack Obama was swept to victory on a national wave of desire for change -- change that included a coherent program for curbing many of the excesses associated with modern American animal agriculture. But, as David Kirby wonders in this Huffington Post column, is the President really ready to do something about it? Posted on November 12, 2009 at 03:58 am by Amy A. Breyer

The New York Times Leora Broydo Vestel November 9, 2009 Until now, debate over the relationship between the H1N1 influenza virus and large-scale concentrated animal feeding operations - defined by the Environmental Protection Agency as agricultural operations over a certain size "where animals are kept and raised in confined situations" - has been simmering outside the limelight. Puppy Vaccinations: Don't Throw the Baby Out with the Bathwater

Given the growing body of evidence that too many vaccinations can cause adverse reactions in family pets, new pet owners often question whether to vaccinate or skip dog and cat vaccinations entirely. Don't throw the baby out with the bathwater advise veterinary advocates for a new vaccine protocol. Here is Dr. W. Jean Dodds' most recent vaccination protocol. Arkansasa Rabies Law: Doing What Doesn't Work Harder

Arkansas government and health officials are at long last updating archaic rabies laws. Rather than mandating annual rabies vaccine, they are leaving the decision up to local veterinarians whether to use a 3 year or 1 year vaccine. Given that the majority of veterinarians who oppose changes to rabies laws depend on annual vaccination as a way to get dog and cat owners into their clinics (read $,) and given that those self same vets make a very nice living off vaccine related illness (read... Rabies Challenge Study in Budget Crunch

Today Kris Christine asks for $125,000 to launch the third year of the privately funded rabies challenge studies currently underway at the University of Wisconsin School of Veterinary Medicine. Advice for Lawyers: How to Develop an Equine Law Practice

I get a lot of inquiries from lawyers and law students about how they can develop a niche practice in equine law. Below are the most common FAQs and my responses. 1. Is there enough business in equine law to make a living? The answer to this is a resounding "yes"! I honestly do not believe the state in which you live will dictate this, either. I left a big firm 2 years ago and have been exclusively handling equine matters since then. I now have more business than I know what to do with. And I... Posted on September 3, 2009 at 06:35 pm

Lien for Texas Large Animal Vets to Take Effect September 1, 2009

Beginning September 1, 2009, all large animal veterinarians in the state of Texas will have a lien on treated animals to secure payment of vet bills. This lien will be effective both before and after the animal is released to the owner. Prior to the effective date of this legislation, veterinarians have no statutory lien on treated animals to secure veterinary services other than board. See "Liens for Veterinarians and Farriers in Texas" (February 18, 2008) As of January 2009, twenty-eight... Posted on July 25, 2009 at 05:59 pm

What Documents Do You Need To Sell A Horse?

Horses are not required to be registered in any particular place or with any particular registry. In fact many horses are not registered at all. The way to clearly evidence the transfer of ownership of a horse is to document the transaction with a purchase and sale agreement, followed by a bill of sale. It is important to start any transaction with a purchase and sale agreement as opposed to a bill of sale. This agreement should contain all the terms upon which the buyer and seller have agreed,... Pardons and turkeys

David Cassuto at the excellent new Animal Blawg has a short piece on the rationale behind pardons and the November ritual of the President, and apparently some governors, pardoning turkeys. He says, "This ritual amounts to transferring the guilt of the perpetrators on to the victims and then forgiving a token few of them in a bizarre act of self-absolution by proxy." Well said. President Bush has granted very few pardons and commutations of the real kind, i.e. ones issued to people convicted of... Posted on November 26, 2008 at 03:17 pm by houndedcowed

Recent cases distinguish among "pests," acts of violence

This is no way to increase this blog's readership, but I wanted to note two recent cases on animal-related classifications. Compared to some other topics (dogfighting! whales!), definitions are a pretty boring topic, but they are the starting point for a lot of animal law discussions. I won't attempt to synthesize the cases, except to point out that poisoning of rodents is mentioned in both. One gets the sense that if, in several thousand years, animal law develops such that legislatures or... Posted on November 20, 2008 at 06:04 am by houndedcowed

Supreme Court invalidates limits on Navy sonar

In a feat of speedy legal writing, the U.S. Supreme Court struck down parts of an injunction limiting the Navy's use of sonar in training off the coast of California. The case is Winter v. NRDC. Oral argument was last month and, as Orin Kerr notes, this is the first argued decision of the term. The fear (shared by me) that the court would okay the Navy's attempt to circumvent the courts via an "appeal" to an executive agency appear to have been unfounded--Chief Justice Roberts's decision is... Protecting Predators of the Sky and Sea

Congress made advances this week on two major conservation bills to protect predators of the sky and the sea. The measures cleared important committees with bipartisan support, and if enacted into law will greatly enhance law enforcement efforts to crack down on cruelty to sharks and raptors. A House committee approved H.R. 2062, the Migratory Bird Treaty Penalty and Enforcement Act, to strengthen the penalties for intentionally killing federally protected birds. Commentary: World Vegan Day—Nov. 1, 2009

Dear Colleagues: Happy World Vegan Day to all of you. In this Commentary, I reflect on the state of the vegan movement. The bad news: the large welfare corporations have done a great deal to marginalize veganism. The good news: in the past year, we have seen the growth of the abolitionist movement, which views veganism as the moral baseline, rejects welfare reform and single-issue campaigns, and considers veganism as essential to any coherent theory of nonviolence. If you are not already vegan... Posted on November 1, 2009 at 08:45 pm by Gary L. Francione

Some Thoughts on the Abolitionist Approach

Dear Colleagues: Here are some simple thoughts that embody the abolitionist approach and philosophy. They may be useful to you in your own thinking about things as well as in your discussion with others: 1. Speciesism is morally objectionable because, like racism, sexism, and heterosexism, it links personhood with an irrelevant criterion. Explanation: We do not object to speciesism in a vacuum. We reject it because it is like other forms of discrimination. What all forms of discrimination share... Posted on October 24, 2009 at 06:25 am by Gary L. Francione

Drawing the line on horse-drawn carriages in Portland

After a horse died on the street while pulling a wedding couple during Portland's recent heat wave, local officials are wondering whether to enact a carriage ban. It should be an easy question: a city with modern streetcars, trams, and light rail should absolutely turn its back on the antiquated animal abuse inherent in working horses in street traffic and summer heat. If the mayor needs more information before supporting at least a significant partial ban on the carriage trade, which is... Posted on August 7, 2009 at 12:34 am by Dane E. Johnson
