CAAF News: which do you want first, the good news or the bad news?

The bad news: CAAF today issued an order changing the deadlines for filing supps. Starting on 1 September, supps will be due in conjunction with the petition where the petition is filed by counsel and 20 days after filing of the petition if filed by the accused. In those rare instances where appellate government counsel file an answer to the supp instead of a 10-day letter, the answer will be due in 20 days. I predict a bumper crop of CAAF petitions filed on 31 August. The good news: Also... Posted on July 15, 2009 at 10:11 am by Dwight Sullivan

Freely speculating on the future of the ATS in a multipolar world

Harvard Law School is hosting in a couple of weeks what is certain to be a very interesting small conference on the Alien Tort Statute. I was lucky enough to be one of the invitees, addressing the issue of corporate liability under the ATS. I address the issue of corporate liability under the ATS, but am actually interested in it from a broader perspective, the "jurisprudential" perspective on the distinct and sharply divided "communities of interpretive authority" over such issues in the ATS... The NYT CIA Assassination Story

I see that I'm quoted by Mark Mazetti and Scott Shane in their New York Times article today, CIA Had Plan to Assassinate Qaeda Leaders (July 13, 2009). I'm trying hard to maintain radio silence and not blog to let my shoulder heal up, but let me say something very brief about this. Also, I only post occasionally here - mostly I post these days at Volokh Conspiracy and Opinio Juris and CTLab. First, I'm delighted, of course, that the CIA post 9-11 was formulating plans to try and kill Al Qaeda... Posted on July 14, 2009 at 08:16 am

Senate Panel Approves Extension of Patriot Act (CLICK HERE)

Bioshock non-spoiler review (Verdict: Great game - buy it used)

"Why should the righteous suffer at the hands of the ignorant?" Because society usually ends up freaky-deeky, that's why. Thus speaks the lessons of Bioshock. Bioshock is a first-person shooter game with a great story. No, make that fantastic story. But ultimately with all stories, it ends, and you end up with little replay [...] Posted on October 3, 2007 at 07:33 am by Aidyn

    Unfit to Serve?

According to an alarming new report, 75 percent of young people ages 17 to 24 are unable to enlist in the military because they fail to graduate high school, have a criminal record, or are physically unfit. U.S. Secretary of Education Arne Duncan and some of America's top retired military brass will hold a news conference at the National Press Club Thursday to call for immediate action to address this national security threat. Military Medical Mistake Disfigures North Texas Airman

From CBS 11 in Arlington ([cbs11tv.com]) Jessica Read is still stunned about what happened to her husband. "It's very hard for us to understand." Last week, 20-year-old Colton Read, who grew up in Arlington and who's now in the U. S. Air Force, went to have laparoscopic surgery to remove his gall-bladder at David Grant Medical Center at Travis Air Force Base near Sacramento. His mother, Shelly Read-Miller says he wasn't worried. "He said 'Mom, this is routine, it's no big deal.'" But what... Posted on July 21, 2009 at 08:43 am by admin

CBS Evening News Follow Up - Military Can’t Be Sued for Malpractice

Last night, CBS News followed up with an update on the story of Carmelo Rodriguez, a Marine who died of skin cancer that military doctors initially noticed but left untreated. Due to the Feres Doctrine of 1950, active duty personnel and their families are forbidden to sue the United States government for medical malpractice. Failure to Diagnose Cancer

Failure to Diagnose Cancer: One of the most frequent medical malpractice issues that we deal with involves the failure to timely diagnose and treat cancer. Over the years we have successfully prosecuted federal tort claims involving cancer of the breast, lung, prostate, colon, kidney, brain, and many others. An issue that comes up in each case is how much damage was caused by the failure to timely diagnose the malignancy? Unlike a surgical or medication error which is directly caused by a... Metro Detroit Hardships Lead To An Increase In Senior Abuse

Unfortunately, the sting of our economy in Detroit, with the struggles of the automotive industry, has reached beyond individual consumers and into seniors' pocketbooks. With the increase in unemployment, foreclosures and other difficult times, the Michigan State Department of Human Services (DHS) and the Attorney General have noticed a correlation in elder abuse. Not physical or mental abuse; but, financial abuse. Most commentators agree that the best way to avoid access to joint accounts or... Posted on July 27, 2009 at 08:23 am by Jeffrey Michalowski

Paying the Debts of a Deceased Relative: Who Is Responsible?

After a relative dies, the last thing grieving family members may expect are calls from debt collectors asking them to pay their loved one's outstanding debts. According to the Federal Trade Commission (FTC), the nation's consumer protection agency, a surviving relative usually has no legal obligation to pay the debts of a family member who has died. In fact, the rights of surviving relatives are covered by the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from... If you have questions and are in Detroit....

Today I appeared on the "Ask Your Neighbor" radio show with Bob Allison. The topic that we discussed was the use of estate planning documents for disability and long term care planning. You can listen to the segment on the 690 am website. Among the highlights that we discussed were the use of power of attorney documents to engage in Medicaid planning and VA benefit planning. Like my last post, we discussed the importance of establishing power of attorney documents prior to the onset of illness.... Posted on June 19, 2009 at 08:39 am by Jeffrey Michalowski

    Blasphemy in Missouri?

Read an "On Religion" article in the NYTs about how a Mr. George Kalman attempted to name his film company "I Choose Hell Productions, LLC" and ran afoul of Pennsylvania's blasphemy law. Blasphemy law in 2009? Hmm. Got me wondering if Missouri has something similar. I did a search of statutes and found no explicit reference to blasphemy&#xe2€&#xa6 However, I did recall limits on vanity license plates. The statute states: "No personalized license plates shall be issued containing any letters, numbers or... Posted on March 24, 2009 at 08:37 pm by grdoty
