When it rains, it pours, and right now there's a veritable typhoon of Superfund liability cases. On September 30, 2009, the federal district court in Georgia ruled on several summary judgment motions in Scarlett & Associates, Inc. v. Briarcliff Center Partners, L.L.C. The primary question was whether a property management service could be liable for remedial costs under CERCLA and/or RCRA. The Court said yes to both. The property in question was a strip mall that housed a leaking dry...

Another comment on the ongoing controversy regarding a proposed tax deduction for pet costs. Attorney Steven Wegner of California recently wrote to us as follows: ..."It is undeniable that most people consider pets as part of their family. It is also true that caring for a pet is a significant expense that should be recognized and receive some relief under the tax code. Given the huge deficits the government is running any measure like Congressman McCotter's bill that reduces government...

The United States Department of Agriculture reports on new research being conducting on the use of cinnamon extracts to prevent cell death following a traumatic brain injury. According the department, the researchers have reported findings that the cinnamon compounds studied prevented isolated brain cells from swelling, one of the many abnormal conditions resulting from traumatic brain injury and stroke due to impaired blood flow to the brain.
This excellent editorial appeared recently in the Dallas Morning News: The Obama administration deserves credit for tenacity. Like Rocky Balboa after being battered and bloodied by successive bouts on Capitol Hill over health care and the economy, the administration keeps coming back for more. Homeland Security Secretary Janet Napolitano announced Friday that the administration will seek to overhaul the immigration system early next year....

Sports lawyers in Taiwan must be having a field day with the most recent allegations of game-fixing and gambling. According to the article, a team has cut two players, and now plans to sue them for their role in the baseball game-fixing scam. Apparently, this is not just an instance of a few rogue players going too far with a gambling scheme. The saga gets even murkier, according to the article: Prosecutors yesterday summoned three additional Bears players - pitcher Hsu Wen-hsiung and...
