It's not often that a critical case can be seen coming before it is decided. However, Bragg v. Linden in federal court in Pennsylvania stands to be possible the landmark case in MMORPG law or virtual law or whatever you would like to call it. For those who haven't been following, the basic facts are that Mr. Bragg was a Second Life real estate developer. He bought some land ("Taessot") for $300. Second Life contacted him soon after saying the land ...

Bragg v. Linden Lab, E.D. Pa. (Pending) Well I had some initial reservation about including this case on our tracking list, given that it wasn't a "pure" IP case. However, in today's day and age, virtual property is the new IP, so we're adding the case to our tracking list, and will keep you posted. In the meantime, here is a link to a nice summary of the proceedings thus far.

Singer songwriter Billy Bragg has written an excellent column in The Guardian in which he writes: Having failed miserably in previous attempts to stamp out illicit filesharing, the record industry has now joined forces with other entertainment lobby groups to demand that the government takes action to protect their business model.............Fearful of the prospect of dragging their customers though the courts, with all the attendant costs and bad publicity, members of the record industry have ...

Here is an interesting Army Times article reporting that Fort Bragg will try three capital courts-martial this summer. For comparison purposes, that's one more capital case than the entire U.S. Army tried in 1997, 1998, 1999, 2000, 2001, 2002, 2003, 2004, 2005, 2006, and 2007 combined. This confluence would appear to heighten the importance of resovling the counsel qualification issue that is currently pending before CAAF in the Martinez writ appeal, which we previously discussed here and here. ...

Wilson and Adam grew up together, but had not seen each other for some time. So it was a happy meeting. Wilson goes over to Adam and gives him a hug, saying "What's up, ...

This morning at my Rotary Club I had the privilege of introducing a special guest named Don Bragg. For those of you not familiar with Don, after graduating from Villanova University as the NCAA pole vault champion, he went on to win the Olympic gold medal in the 1960 games in Rome (yes he brought his medal to our meeting). Don's nickname was Tarzan because of his size and strength. He was also slated to take over role of Tarzan after Johnny Weissmuller retired. Don shared many stories about his ...

Hard to believe. Not exactly the characterization of your case you hope for from the military judge.
