Tim Bray over at Ongoing does some light speculation about how we should understand the accelerating growth in ways we communicate with each
other. He starts with the timeline you see to your left and then goes on to play with ways of comparing and charting the means at our disposal today, wondering where the holes in the

On April 23, 2008, the Supreme Court heard oral argument in MetLife v. Glenn. The case asks whether an ERISA plan administrator that both evaluates and pays employee benefit claims
operates under a conflict of interest and, if so, how such a conflict ought be weighed on judicial review of benefit determinations. Attorney Samuel Bray of Mayer Brown discusses the case.

... and, if so, how such a conflict ought be weighed on judicial review of benefit determinations. The Court held that this dual role creates a conflict of interest; that a reviewing
court should consider that conflict as a factor in determining whether the plan administrator has abused its discretion in denying benefits; and that the significance of the factor will
depend upon the circumstances of the particular case. Samuel Bray, an Associate in Law at Columbia Law School, discusses the case.

Tim Bray says (via Twitter): If you watch the storm trackers, you might get the impression that Gustav could both moderate and veer left of
NOLA. That'd be good. Yes, indeed. As I write, there are varying reports of Gustav weakening to a Cat 3 then being expected to strengthen again to a 4 or 5. Prayers to the appropriate

The National Association of Realtors has long been a favorite target of this blog, primarily because we love to bag game that's easy to hunt, and NAR is so easy that it really ought to
be considered roadkill. Last year, NAR President Pat Vredevoogd Combs boldly predicted that Congress would enact a permanent ban on national banks entering real estate brokerage by the
end of 2007. Didn't happen. Then there was the long -standing battle to prevent Wal-Mart from getting a bank charter, which NAR ...

he basically became a media phenomenon. People wanted to trade with him just to get their name in the paper. So there's the secret, revealed: Come up with a great idea, turn yourself
into a media phenomenon, and parlay that into owning a home. And don't forget to write a book about it. I promise to read it! Ilona Bray

... the pond is a good reminder that, in any house sale, it ain't over till it's over. Sellers and buyers, ethically or not, may try to mold the agreement to their interests and pull
last-minute surprises. Usually the surprises are minor, and easy to negotiate around (another reason to choose a real estate agent who's a good negotiator). But in case of major
surprises, realize that even with a binding contract, you may need to make a trip to the courthouse to enforce your agreement. Ilona Bray

many offers they anticipate, ask your agent to pull up actual sales prices on comparable houses sold within the last few months (or research these yourself on sites like Zillow), talk

total of around $1.4 billion for Halloween decorations this year. Although that still translates to an expenditure of only $26.59 per person buying, the numbers have been steadily
rising - and retailers are responding with new temptations. And we're only at the start of the holiday buying season . . . . Ilona Bray

as fires, earthquakes, and floods) are unlikely, but the message here seems to be, why gamble on such a huge part of your life - and your net worth? The other major blunders are mostly
focused on retirement planning and keeping yourself healthy. But when it comes to homeownership, insurance is a biggie. Ilona Bray
