We had one session on "Teaching Disney" and another devoted to Disney-related scholarship. Kudos to Deborah DeMott, who organized the sessions. Last year I had some unkind words for the Section on Agency, Partnership, LLCs, and Unincorporated Associations. This year's program was a substantial upgrade, with our own Vic Fleischer leading off. Via Dorf on Law a comment on the DC area Madame who is atempting to release the names of her customers. As Dorf points out it is an intriguing legal strategy. The legal case against Deborah Jeane Palfrey, who ran an accused prostitution ring under the name of "Pamela Martin and Associates," raises a nice question about the dual use of evidence. Ms. Palfrey says that her 130 escorts provided only legal services --- such as massages and erotic dances --- for her 15,000 customers. She plans to ...

I have been thinking about how to comment on the news that Whole Foods' CEO John Mackey posted on a Yahoo stock-market forum under the alias "Rahodeb," which is an anagram of Deborah, his wife. Fortunately, Jeff Lipshaw has saved me the trouble. I must say, though, despite Jeff's noble effort, words cannot adequately convey the extent of Mackey's stupidity. Mackey should be canned. Immediately. (If you disagree, take a few minutes and read some of Mackey's posts. The sidebar in this W$J story ...

I am in the process of revising my Business Organizations casebook for a second edition, and I am integrating insights from the Restatement (Third) of Agency. Deborah DeMott has produced an amazing work, and I find it quite fascinating reading. Seriously. One of the most noticeable changes in the Restatement as you move from the second to third edition is the purported elimination of "inherent agency power." I always found inherent agency power a useful, if somewhat confusing, concept. It is ...

... it is) but also to be, in this sense, false? Or perhaps academic freedom extends as far to continue the professor's employment but to insist that he retitle his course not Molecular Biology but rather something to the effect of Professor Smith's Imaginings of the Biological World? Law, of course, is not science-as much as it might pain some of us to admit. It is difficult in the extreme to declare a legal proposition false with the same kind of certainty with which one can declare evolution a ...

August is not the time of year when I normally think about student evaluations, but I have been re-designing my Business Associations course this summer, and in doing some background reading on teaching, I stumbled across an interesting article by Deborah J. ... Michael Jackson got a confidential order from a Superior Court stating that he was the child's sole legal parent. If so, then Blanket is now an orphan, and will remain so absent an adoption by someone. My wish for the Jackson children, as with Anna Nicole Smith's baby, is that the fight over their parentage be a fight between people who love and want them, and not a fight to lay claim to a piece of Michael Jackson's fame or fortune. These are children. They deserve a loving family, regardless of ...
