... gets me about this section is the heading: "Supreme Court favors businesses over consumers." Is that really what these cases are about? I have read political accounts of the Supreme Court opinions in newspapers and periodicals or blogs that read this way ("The Roberts Court wants to stick it to the consumer - I can prove it: the Defendant won in all 4 cases this term"). But I've not heard law professors take this route too often, and never an antitrust commentator. In fact, a reasonable reading ...

I had court in Dallas this morning. Like many mornings with court I didn't eat breakfast at home. Luckily, Frank Crowley has a restaurant with breakfast served until 10:30. The first clue that this breakfast was not going to be top quality was when the eggs were scooped out of a warming tray. Now, I could have gotten eggs to order ...

Here's another reason-as if you needed it-as to why getting a reasonable bailout of the mortgage-backed securities market through Congress was so difficult. Below I reproduce an analysis from Gregg Easterbrook of the Brookings Institute: Supposing we assume the bailout is required, here is what bothers me about the plan so far: Taxpayers don't get stock, what they get is warrants that can be exchanged for stock, and nonvoting stock to boot…. Even if the warrants are called [sic, Easterbrook ...
