Possibly off interest in a non-tabloid vein are my thoughts at the end about how this blog aspires to leave a legacy of insights and knowledge about law departments. That is my vision, and comments or emails from readers help me move toward it.

That's the title of Nina Morrison's post at the Dallas Morning News Death Penalty blog. LINK It addresses the recent OpEd, noted here, written by one of Todd Willingham's prosecutors. Morrison is a staff attorney at the Innocence Project and has been involved in several Texas exonerations. Here's an excerpt: Judge John Jackson, who prosecuted Cameron Todd Willingham in the 1990s, recently wrote in the Corsicana Daily News that "facts" showing "overwhelming evidence" of Willingham's guilt are ...

We can't just change the boat's name - that's what it's called."

... on Justice Thomas specifically. Personally, I doubt that Justice Scalia would have really struck down the Partial-Birth Abortion Ban Act as a violation of the Commerce Clause. While he had been a strong supporter of federalism in US v Lopez and US v Morrison, Scalia held back in Gonzales v Raich, the California medical marijuana case (I'll be discussing that case further in the post). Justice Thomas, as well as then-Chief Justice Rehnquist and Justice O'Connor, stuck to their federalism guns. ...

The recent news is that you can use a BlackBerry device to record, edit and play voice recordings. You can also upload those recordings wirelessly to an assistant who can complete or transcribe the tape. This capability came to my attention through an article in Peer to Peer, Nov. 2007 at 34 by Steve Butterworth, President of BigHand, Inc.

On one side we have larger firms like Morrison Foerster, Mintz Levin, Lane Powell and my former Canadian law firm Clark Wilson. And on the other side, great contributions from solos like Lisa Solomon, Doug Cornelius, Amy Becerra, Mitchell Matorin and Stem client Florida criminal lawyer Ron Chapman. Add ...

A piece in GC Mid-Atlantic, June 2008 at 8-9, describes the role Steve Fulton, the general counsel of $1.2 billion in revenue Respironics. His legal team consists of nine attorneys and three support personnel. The article comments that Fulton "wears two hats. A friend sent me some ideas Steve Prokesch posted on April 21, 2008 for the Harvard Business Review site. I have slightly edited them. Compare your calendar with your priorities. Label the purpose of every regular or recurring activity on your quarterly calendar and highlight those activities that further your top five priorities. This simple exercise will reveal where you're squandering time (See my post of Sept. 3, 2008: general counsel lose control of their calendar.). Be ruthless. Instead of ...

Heather Morrison of the CNW Group, formerly Canada News Wire, released a 11-pg report yesterday titled Canadian Law Firms and their Use of Social Media. I am quoted in it, so please excuse the vanity reference. The report itself offers a nice overview of the benefits of social media investment. That's important, but the part I appreciated most was the focus on relationship building. Great relationships are a key driver of success for any law firm (or lawyer's) search strategy. The reason? ...
