Although the Proposed Rule does not require states to adopt a regulatory structure for AMC registration and supervision, AMCs would be prohibited from providing appraisal management services for federally related mortgage transactions in a state where such a regulatory structure has not been adopted. The Court of Appeals of the State of Illinois, First District, recently affirmed a summary judgment ruling in favor of a mortgage lender on an appraiser’s claims of intentional interference with a business relationship arising from the lender barring the appraiser from working on its loans and notifying various appraisal management companies of this decision. In the last 24 hours Paratus AMC Ltd changed their CML Part 2 requirements to : For re-mortgage applications the customer must have owned the property for at least 12 months.Sub-sales, where the seller has owned the property for less than 12 months and back to back transactions are not acceptable.Applications which involve assignable contracts or irrevocable powers of attorney in favour of intervening sellers are not acceptable.
