Some DERs (Consultant DERs) are independent contractors while others, although they work for the manufacturers (Company DERs), are part of a culture where they are deemed to owe their loyalty to the FAA rather than their employers; in fact, DERs are appointed to represent the FAA and are legally required to maintain objectivity (pdf, p. 21).
