Mervyn's LLC case, on remand, the Court of Appeal issued an unusual unpublished opinion (which you can read here in pdf or Word format) holding that the appeal of the case (the whole Prop 64 issue arose from a dismissal of a pending appeal due to the new rules under Prop 64) could proceed with the original litigant until such time as the case is won or lost on appeal.
