Yesterday, in Cubas v Martinez, 2007 NY Slip Op 04723, the Court of Appeals rejected a challenge to the DMV regulations by plaintiffs who argued that (1) the regulations were unauthorized by statute, (2) infringed on constitutional protections, and (3) violated procedural requirements applicable to agency rules and regulations.
