Reviewing en banc the appeal of a jury award in favor of a male ironworker who was allegedly sexually harassed by a superintendent because he wasn’t manly enough, the Fifth Circuit, in a 10-6 decision, found sufficient evidence that the harassment was because of the employee’s sex and was sufficiently severe and pervasive to alter his work environment (EEOC v Boh Brothers Construction Co, LLC, September 27, 2013).
