My last post provided an overview of the Berman hearing process when an employee begins a claim for unpaid wages with the Labor Commissioner. If the parties do not settle the claim at the settlement hearing, then the matter will be set for a Berman hearing pursuant to Labor Code 98(a). Must.   Igor Palagin was a welder.  He filed a labor commissioner claim for underpayment against Paniagua Construction. Paniagua claimed Palagin was not its employee; rather, he was a subcontractor.   The DLSE found in favor of Palagin. The Florida Automobile Dealers Association (FADA) released a Legislative Alert earlier this year, encouraging member to support their lobbying effort to have Fla. Stat. 501.98 passed into law. This statute provides that before a consumer can sue a dealer for violations of Fla.
