Toyota is voluntarily recalling almost 6.4 million vehicles worldwide, 1.8 million of which are from the U.S., after finding out about seat and steering wheel problems. A document issued by the Japanese car manufacturer to the National Highway Traffic Safety Administration stated that some of the recalled models have a defective seat adjustment railing that might fail to lock front seats. Other defects include a steering wheel that might cause the airbag system to malfunction. This recall was issued… [read post]

In filing a Tuscaloosa car accident lawsuit, an experienced plaintiff attorney looks beyond those obviously negligent. The at-fault driver behind the wheel will be named in any negligence lawsuit. However, other parties may be found vicariously liable for the actions of that driver. In English common law, this was known as the "theory of respondeat superior." This is the principal that allows employers to be held liable for the actions of an employee committed within the line and scope of his or… [read post]

Today’s tally has two more truck wrecks to report. Yesterday afternoon just as rush hour was at its peak a tractor trailer hauling garbage flipped over as it curved on an on ramp entering Route 130 in Pennsauken, New Jersey. From the video posted by WPVI, it is clear that the driver was carrying too much speed on the curve and his rig fell on its side and spilled the garbage all over the highway. In any truck rollover, experienced lawyers who handle cases like this know to quickly investigate… [read post]

A tragic auto accident occurred Thursday morning around 6:30 a.m. in Russell County, Kentucky. This was a two vehicle accident that occurred on Highway 80 near Russell Springs. The drivers of both vehicles died from the injuries sustained from the crash. Accident re-constructionists are on the scene trying to determine the cause of the wreck and what happened. Once fault is determined, the family of the not-at-fault driver will be able to levy a Kentucky Wrongful Death Claim against the… [read post]

Michigan senators want to reduce points on driving records for speeders who endanger workers and other drivers with (SB 895-898). Why? Yesterday, I wrote about a recent, dangerous package of Senate bills (SB 895-898) that would allow drivers to go faster in construction work zones.  These bills would also raise speed limits to up to 80 miles per hour. Rightly so, Michigan imposes serious  penalties on drivers who endanger construction workers by speeding in work zones. Under existing… [read post]

Two major factors in deciding the value of any automobile accident case are liability and damages. Damages, which we'll discuss in a later post, include things like medical bills, lost wages, pain, suffering and incapacity. Liability is used (often incorrectly) by lawyers to refer to negligence. In some cases, lawyers might tell the judge or jury that they have conceded liability, which is taken to mean that the defendant admits to being negligent. Technically, if a driver is liable, he was… [read post]

A hit-and-run crash in Stuart on Monday that left a motorcyclist hospitalized is the result of a texting driver, according to police. The suspect, a 29-year-old man, was texting while driving when he struck the motorcyclist and fled the scene. A citizen driving near the intersection of Indian Road and Willoughby Boulevard in Stuart on Monday reported the incident to police when he noticed the man hit the biker and failed to stop. The 911 operator confirmed the location of the citizen and police… [read post]

What if someone is driving without car insurance and has an accident with me, can I still get compensation for the damages?   Although it is against the law in most states to drive without automobile liability insurance many irresponsible individuals insist on driving around town without coverage. If they get into accidents in which […] [read post]

It appears as though the smallest, seemingly insignificant decision brought an auto giant to its knees. Media outlets and the general public alike have been closely following the General Motors recall crisis, searching for answers and where to place blame. After months of mounting mistakes and shifting responsibilities, a memo discussing a fix for the ignition switch problem plaguing millions of GM vehicles was uncovered by congressional investigators. In it, according to Forbes Magazine’s… [read post]

GM has been under recent scrutiny for covering up the defective ignition switches tied to the deaths of at least 13 passengers. Now the CEO is creating a team to focus on vehicle safety. According to reports, the new safety organization within GM is designed to build on existing formulas to make cars the "best to drive in the industry." This positive PR may be good preparation for the media spotlight at the New York International Auto Show; however, it does little to help the victims who suffered as… [read post]

I was out of the office last week so I need to catch up the “Truck Accident Tally” portion of this blog. Unfortunately, there was a lot of activity while I was gone. Three pedestrians have died as a result of being hit by commercial vehicles. A 19 year old pedestrian in Delaware was hit and killed by a tractor trailer late last night. Apparently the pedestrian was reported in the road by a passing car before he was struck and killed by the truck. On April 13th just after 10 P.M., a… [read post]

Personal Injury Law and insurance claims handling practices have trends. Just like we see trends for runway fashion, or trends on a celebrity packed red carpet; we see trends for accident law. What's hip, sexy, or cool for one insurer, or for one judge on a case, will likely apply to the next insurer or judge. It's a copy cat industry. Now law isn't as trivial or fickle as the world of fashion. It takes judges to rule on the law. It takes politicians to create law. It takes people to elect those… [read post]

Picture in your mind a construction worker near the bright orange cones.  Imagine him working in the hot sun, fixing roads this summer. Now imagine drivers whizzing by him at speeds  of up to 70 miles per hour. This will be the new reality for far too many construction workers if a dangerous and ill-advised package of bills (SB 895-898) becomes law. These bills would  revamp Michigan’s speed limit laws. They will mean speeding big rigs – as trucks would be able to legally… [read post]

Ah!  The warm weather has finally arrived throughout the United States and with it comes plans for a fun-filled summer.  Unfortunately, all too often unexpected car repairs or Tampa auto accidents can ruin those plans.  One of the more common car failures involves the cooling system.  This is the essential component of any vehicle that maintains normal operating temperatures and keeps the engine safe from overheating.  When the cooling system fails, the heat gauge on the… [read post]

Drivers throughout Boston break the rules of the road every day and some of those drivers receive traffic tickets. As a new report from CNN shows, drivers who break the rules and receive citations face significant costs as a result. Even a relatively minor driving violation can result not only in a fine but can also significantly increase your insurance rates. These higher costs will affect your budget for a long time to come. Avoiding dangerous driving behaviors is smart to prevent a ticket and… [read post]

As discussed in a recent decision from the Massachusetts Appeals Court, to sustain a claim of negligence, a plaintiff must establish that the defendant owed him a duty, that the defendant breached that duty, that the plaintiff was injured, and that the defendant's breach was the cause of those injuries. Defendants often attack the elements of a plaintiff's negligence claim by arguing that the plaintiff cannot prove "causation." In other words, the defendant claims that even if there was a breach… [read post]

With spring in full swing, high school seniors are preparing for prom, graduation celebrations and one last summer of fun before embarking on the next chapter of their lives. What parents may not realize is that these gatherings often involve alcohol consumption. Numerous studies have shown that teenagers are more prone to dangerous binge drinking than those in other age groups. As April is Alcohol Awareness Month, our Daytona car accident attorneys intend to drive home the point that parents must… [read post]
