The Alaska Section of Epidemiology is investigating another outbreak of Campylobacter infection associated with the consumption of raw milk. This new outbreak is associated with raw milk distributed by the same Kenai Peninsula cow-share program that was linked to a Campylobacter outbreak sickened at least 31 people in February 2013. The Sixth Circuit split with the Second and Ninth Circuits today on what a plaintiff must plead under section 11 of the Securities Act of 1933 in cases that involve opinions, views, and other "soft" info. The jury in the Jodi Arias trial has ended in a hung decision regarding whether or not to sentence her to the death penalty. Unless the Maricopa Attorney’s office decides to take the death penalty option off the table the case will be headed to a new jury. California has an "implied consent" rule regarding chemical testing that is found in Vehicle Code Section 23612. This vehicle code section states, "Any person who drives a motor vehicle is deemed to have given his or her consent to chemical testing of his or her blood or breath for the purposes of determining the alcoholic content of his or her blood if lawfully arrested for an alleged DUI." Often times I'm faced with the question of whether a jury trial can be obtained in an admiralty case, and whether admiralty cases must be filed in federal court. I was once trying a case in a federal district court involving an admiralty case, and an expert walked in the courtroom about to testify. He stopped with a look of surprise on his face, and asked how come a jury was deciding the case when it was an admiralty matter.
