All California lawyers must strictly abide by a code of ethics or risk being disciplined, and in extreme cases of professional misconduct, lose their license to practice law in California. There are different sets of rules for different aspects of the legal process, including the California Rules of Professional Conduct. The State Bar of California maintains an “Ethics Information” page on their official website. This page essentially serves as a clearinghouse for all matters relating to… [read post]

Drunk driving is the second leading cause of fatal car accidents, costing the nation approximately $130 billion, and more importantly, many lives. However, there is another factor responsible for taking even more lives. Did you guess speeding, distracted driver (texting while driving, etc),… [read post]

I am often asked, "Can I change my lawyer in the middle of my case?" by people who have already retained a personal injury attorney but for a variety of reasons are dissatisfied and want to switch counsel. The answer is yes, but there are a number of issues that require consideration by both the client and soon-to-be-former lawyer about how and when the transfer of the matter can take place. Over the course of the next several posts, we will examine those issues, including how a client's file… [read post]

College Station Coco Loco restaurant was the source of the E. coli that caused illnesses in the Bryan/College Station area, according to health officials.  At a Brazos County Health Department press conference Tuesday afternoon, officials stated they had tracked the bacteria back to ground beef at the Coco Loco location in the 300 block of George Bush Drive. While they said it was not a 100 percent certainty, they said it was “highly likely.” In all, there were five confirmed cases… [read post]

A February 27, 2013 Iowa Court of Appeals opinion serves as yet another real-world example of how and why taking the time to set up a formal entity – in this case an Iowa LLC – can benefit and provide protection to the LLC’s owners (whether members or managers).  In the February 2013 opinion, the Iowa appellate court upheld a district court’s order that refused to allow a third-party (the plaintiff) to pierce the veil of an LLC in an effort to hold the… [read post]

One of the worst things to happen to injury law is the ability of the defense attorney to create a conspiracy between the doctor, lawyer and injured victim.  There is no doubt that America now literally hates the injured victim.  If you are in a car accident, literally sitting still, and you are hit from behind, you better be lily white and pure if you expect to collect reasonable money from a jury.  If you have prior accidents, if you are partially at fault, or if your injuries are… [read post]

Colorado law, including Department of Health regulations, provide that an individual suspected of drunk (or drugged) driving must be given either a breath test or a blood test within two hours of the last time they drove. This is designed to get the most accurate reading of the chemical content in a person’s system, close to driving. Refuse a Test = Suspension of Driving Privileges Colorado courts have decided that drivers must cooperate (in other words not interfere) with this process. Any… [read post]

South Florida Condo Ownership is Different Than Owning a Single Family Home For those looking into buying a Florida condo or townhome, as well as those who own a condominium here in Florida as either their home or as an investment property, one of the key considerations in this type of real estate ownership is the reality of dealing with an association or board.  Buying, owning, or renting out a single family home means you make the decisions yourself: will there be a hot tub? what color will… [read post]

Attorneys give more of themselves than do those in other professions? They may be fightin’ words. I discovered that this past weekend, when I repeated (via Twitter and in person) new research showing that attorneys rank pretty highly in the generosity department. They came out near the top in a “professional social responsibility by professions” ranking. First, I have to say that the findings didn’t surprise me. Most of the lawyers I know give legal services for free or at a… [read post]

I’m teaching a CLE with a colleague today, and I’m excited about both the topic and the presentation. Teaching a CLE, however, can be a lot of work. I have heard  more senior attorneys wonder if the non-billable work (creating the materials, the powerpoint, and the presentation) is worth it. Will the CLE help their reputation? Their business? I have no idea, but I can speak first hand to benefits new attorneys can reap when they jump into the CLE-teaching… [read post]
