Summer is fast approaching, and here in Waynesville, some of the most popular activities involve water sports on the Nantahala River and various creeks. However, our Waynesville injury lawyers also know that these activities can be as treacherous as they are enjoyable, so it's important to make safety a priority, whether you're riding an inner tube or a raft or paddling on a canoe or kayak. Just a few years ago, a kayaking instructor was killed after braving rapids in the Great Smoky Mountains… [read post]

Have you ever been behind the wheel of a large SUV in Miami? The feel of driving a taller, larger and heavier vehicle gives the driver of these vehicles more confidence than those driving smaller cars. This added confidence sometimes makes these drivers feel that they are the "kings and queens" of the road causing them to disregard the other cars. This added confidence is much greater for a truck driver and their indifference to other vehicles is even greater than that of individuals driving SUVs.… [read post]

There has been a lot of talk about firearm insurance in recent months. The phenomenon is completely understandable given the tragic stories that continue to litter Saint Petersburg newspapers and those throughout the country. The loss of life as a result of firearms is heart-wrenching, and that emotion isn't all innocent families will face should shootings continue to occur. This is why many people are pushing the mandate for all gun owners to carry firearms' insurance policies. The difference… [read post]

Matthew Powell In part one of this two part blog, I mentioned the first three stages of a personal injury lawsuit.  I will now cover what comes next.  This begins with motions. Motions. These are requests made of the courts by your lawyer, asking that a ruling be made.  Pre-trial motions can end the case entirely, should the court make a ruling to do so.  This is referred to as a dispositive motion, such as a motion to dismiss.  In many instances, however, the lawyer is… [read post]

Injuries resulting from dangerous conditions on commercial or personal property amount to a significant number of cases in the personal injury arena. Often times, these injuries are a result of a defective condition on the property that was either known by the owner or should have been noticed by the person in control of the real estate. It is when these conditions go unnoticed over a period of time that injuries can result. Unnoticed property safety hazards give personal injury attorneys difficulty… [read post]

Yesterday there was a terrible construction accident at the Montgomery Mall Parking garage. One man was killed and another was apparently seriously injured. Our thoughts and prayers go out to the family of the man killed and to the man who was seriously injured. Construction accidents like this typically occur because safety rules are not followed. A 50,000 pound slab of concrete collapsed in a parking lot that was under construction. The injured worker was pinned for hours before he… [read post]

In 1975, the Medical Injury Compensation Reform Act ("MICRA") was set into law in California. This law unfairly limits the amount of money that a victim of medical malpractice can receive for his or her pain and suffering to only $250,000. This amount has not gone up with inflation in 38 years and is the limit regardless of how severe the injury and malpractice. For example, if a doctor were to negligently remove the wrong leg of a patient, the pain and suffering of the crippled patient is… [read post]

This past March, Florida’s Second District Court of Appeals tackled an important issue in the case of Smith v. Llamas, addressing the inquiry as to whether a Florida car accident victim’s injuries are temporary or permanent and if this question should be answered by a jury. The Court ultimately held that the permanency of injuries is a question of fact, and, as such, is the sole province of the jury. In Smith, Fernando Llamas was injured in car accident when his vehicle collided with… [read post]

Not only will troopers be looking for those who are neglecting to use their seatbelts, they will also be cracking down on drivers using their cell phones. Around the same time last year, the WSP… [read post]

When a person is killed because of another person’s neglect or a company’s recklessness, Idaho law allows a lawsuit to be brought for wrongful death. Until Idaho Code section 5-311 was passed, a negligent person had no responsibility if they caused an injury so severe it led to a death.  That statute now allows a person’s spouse, children, stepchildren, and parents to assert a claim for their losses where a death is caused by negligence or other wrongful act.  In… [read post]
