That result was rejected by the Court in Lohr, and neither the MDA nor Riegel supports it.2009 WL 331470, at *7 (citations and non-rant portions omitted).The problem is we don't know if the premise of the rant is true or not, because plaintiff failed to plead anything other than "I got hurt, therefore defendant must have violated the FDCA" - which is even more of a stretch than "I got hurt, therefore defendant must be liable.
