Another possibility I suggest is that something like an O'Brien test should be applied to conduct (discriminatory admissions policies) where the government action is not directed at the expressive message entailed.I would be open to -- and equally troubled by -- a claim by Kamehameha Schools of a First Amendment constitutional right to exclude non-ethnic-Hawaiians as essential to maintaining their distinctive message and viewpoint.
