If you have a case and there's a motion to compel arbitration, and the arbitration clause is determined to be unconscionable, and it goes up on appeal and back, and you have other plaintiffs with the same provision, it's not res judicata as to these other plaintiffs' cases, because they're decided on a case-by-case basis.
