I'm reluctant to point this out, but there is rather a direct line from the 1964 Civil Rights Act provision that prohibits private discrimination on the basis of race and Professor Rhodes suggestion (see immediately below) that we legally prohibit discrimination against ugly people (the appearance-challenged?).
