Which makes sense, and the substantial tension between the majority opinion and prior Ninth Circuit precedent gives additional reason to take the case up.Mind you, I don't think the decision of the en banc court is a foregone conclusion, and if it does go up, I'm confident it'll be a split decision. I assume that part of the reason is that these cases have an unusually high rate of going to trial -- rather than plea out -- due to the relatively high sentences and the fact that the defendants are often not your "usual" criminals who understand that a stint in the joint is the price you must occasionally pay for your profession. Judge Kleinfeld's opinion also raises some very good points: one of his best lines (though you gotta read the opinion to understand the context) is his argument that "someone driving his mother, a child of the sixties, to Thanksgiving weekend, and putting her suitcase in the trunk, should not have to open it and go through her clothes" in order to avoid being guilty of possession.
