My problems are mostly at the level right below Huawei and Qualcomm:I would normally assume that companies like Ericsson, Nokia, Samsung, and LG are roughly on an equal footing (Ericsson probably being the number one among them)--to give you a ballpark figure, I would expect each of them to hold around 10% of the relevant patents. I'll try to find out more about this.On Friday Vice President Almunia gave a speech at Fordham's Competition Law Institute Annual Conference in New York and mentioned that "Samsung has sent [the Commission] a set of commitments seeking to address [its] concerns" and announced a market test: "We will formally market test these proposed commitments with other market participants in the coming weeks." Last year Microsoft also sued Samsung, but that was a contract (as opposed to infringement) case, and it was settled recently (also before any ruling).I guess Google will lend some support to Kyocera with respect to software patents that would be infringed by all Android devices should Microsoft's allegations be true.I used to believe for a long time that Microsoft had a patent portfolio especially in connection with operating system technologies that would really enable it to win… [read post]
