In fact the presence of a claim in an ad is an implicit representation that it is or should be material to choice, and we routinely understand it that way - my favorite example comes from an ad for coffee that said "made with smaller grounds" - people liked it better, even though they were given no reason why smaller grounds were better and in fact there's no objective evidence that they are.
