The best way to prevent this issue is to make sure that all real estate is transferred by a new deed to the trustee of the trust, make sure all checking/savings/regular investment accounts are changed from individual accounts to trust accounts, and that proper beneficiary designations are made on assets such as life insurance, 401(k) accounts, IRA's and similar assets with designated beneficiaries. This even after Obama described his tax plan and specifically explained why a small business owner (especially a first-time small business owner) would not see his taxes increase under that plan.I am sure that there is a way to argue that any tax plan can indirectly harm small business owners, and the McCain campaign might well be putting out an argument to that effect as I write.
