One thing to note is that this proposal includes a risk of harm analyis (ROHA) which leads me to believe that the ROHA currently in HHS' HITECH Interim Final Rule on Breach Notification is like to stay in the final rule, despite all the controversy surrounding it (e.g. all the push back from consumer groups that this essentially lets the healthcare industry off the hook).
