After a really bad couple of months for plaintiffs in which the defense teams for Merck had a run of resounding wins in the Vioxx litigation ( and according to all observers they really drilled the plaintiff attorneys in both cases ) a Texas state court judge has handed a win of sorts to plaintiffs in a closely watched decision on the Leonel Garza case down in Rio Grande City, TX. In what can only be described as a big time warning shot from the State of New York Insurance Commissioner, Eric Dinallo, a letter has been sent to all licensed agents in the state regarding laws on the books that prohibit an agent or broker from making any misleading representation or misrepresentation regarding the financial condition of the insurer in order to induce the person to lapse, or surrender any insurance policy. Well, as we have all read in the news and watched on TV, AIG in the wake of reporting a $60 Billion loss for the quarter has now reworked the terms of their deal with the US Government to modify the loan terms, reduce the interest payments and exchange debt for equity, all in return for another $30 billion in cash. US Airways pilot, Captain Chesley "Sully" Sullenberger ditched his disabled jetliner, US Air flight 1549 into the frigid Hudson River on Thursday afternoon after a collision with a flock of birds apparently knocked out both engines, but officials said rescuers safely pulled all 155 people on board into boats as the plane sank.
