Unlike commercial burglary, shoplifting cannot be charged as a felony unless the person charged is a registered sex offender under Penal Code section 290, or if the person charged has a prior conviction under Penal Code section 667(e)(2)(C)(iv).What is particularly interesting about this section is 459(b), which states:Any act of shoplifting as defined in subdivision (a) shall be charged as shoplifting.
