The court referred to the recent Constitutional Court judgment in University of Johannesburg v Auckland Park Theological Seminary and Another (CCT 70/20) [2021] ZACC 13; 2021 (8) BCLR 807 (CC) which affirmed that an expansive approach should be taken to the admissibility of extrinsic evidence of context and purpose whether or not the words used in the contract are ambiguous.
