Es claro que la sentencia del TC en este caso fue irregular, y que interpretación que hace de los hechos fue sesgada pues desvirtúa la voluntad del propio José de la Riva-Agüero al considerar válido solo el testamento de 1938, con el argumento falaz de que el anterior (1933) quedaba derogado por la sola existencia de este testamento.
