Brian Wolfman and I filed a brief on behalf of Public Citizen supporting the plaintiffs' request and pointing out that if complying with regulation were enough to allow a defendant to remove a case under the law, a host of industries that are in fact subject to much heavier regulation than cigarette makers would have free rein to remove cases filed against them in state courts to federal courts.
