There was no further appeal, and a different federal district judge subsequently denied a motion for reconsideration (based on the Texas Supreme Court’s resolution in Henry) after remand and transfer from the original district court.In Vine, all of the involved federal judges except 1 dissenting judge on appeal ruled in favor of waiver and therefore against arbitration.
