I suppose it is predictable that the Solicitor General would appear in support of B&B: providing institutional support for the PTO and the Board, which presumably would resonate more generally to give federal administrative rulings more preclusive effect in general, the Solicitor General argues that the Board’s rulings are entitled to preclusive effect when the Board considers the same question as the district court.
