During the COVID-19 PHE, the Ryan Haight Act’s in-person medical evaluation requirement was lifted under the fourth exception, thereby allowing DEA-registered practitioners to prescribe Schedule II-V controlled substances during audio-video telemedicine encounters and certain audio-only visits without requiring a prior in-person medical evaluation. Notably, the proposed rules also give DEA-registered practitioners who have relied on the DEA’s emergency waiver—which, since January 2020, has allowed practitioners to prescribe Schedules II-V controlled substances without conducting a prior in-person medical evaluation of the patient—up to 180 days to come into compliance with the new in-person evaluation requirements that would be implemented in the final regulations.
