A historical interpretation of the law as made by the Enlarged Board of Appeal in R 18/13 shows that the reports on Article 122 EPC, only state that “the Conference did not want to rule out that an employee could be excused”, while the possibility of apologising for any fault on the part of the applicant or the representative was not discussed.
