When it reaches the Ninth Circuit, the panel that's drawn includes a district court judge sitting by designation from the SDNY and . . . two Ninth Circuit judges appointed by President Trump, Judges Nelson and Lee.You can probably figure out how the opinion turns out just knowing those facts.Look for an en banc call shortly.
