I had noticed over the last couple of days Lucy Reed of Pink Tape, Giles Peaker of Nearly Legal and others on Twitter getting all of a lather over Ken Clarke's recent comments about the profession's opposition to the proposed legal aid cuts (I thought he made the comments several weeks ago, but the reason for the delayed reaction may be that this interview has only just gone online). In the case of a claim against trespassers there needs to be “a substantial risk of public disturbance or of serious harm to persons or property which properly require immediate determination” (CPR PD 55, para.1.3).Both the judge and the first defendant (represented pro bono by the marvelous Emily Wilsdon, and instructed by the well-known housing law nut, Giles Peaker) took the point that, well, the claim didn’t come within the scope of the practice direction. It does not look as if s12 is limited to allotments as it talks about ‘any lease or tenancy or in any covenant, contract or undertaking relating to the use to be made of any land’ Giles Peaker wrote a brilliant post on this here in 2011 when he pointed out (in the comments) that the act is still good law but that it would not extend to cockerels. I do know a lot of stuff, I represent people in court many times in a month and usually win my cases, I train others in housing law, but I admit I don’t have the subtle level of legal knowledge of people like Tessa, Giles Peaker or Francis Davey. [read post]
