The district court judge thought it would violate the Eighth Amendment to sentence two ranchers to a mandatory minimum five years in prison for setting a backcountry fire on their own property (in one case, as a backfire to stop an existing fire caused by a lightning strike) that accidentally escaped and burned a small portion of public land.The Ninth Circuit, by contrast, thinks that such a sentence is just fine.
