So there's a risk the CCA will set some particularly ugly precedent just to send a personal message to Dow, rather than calculate what's really the fair way to handle tardy, last-minute capital submissions.I hope cooler heads will prevail, particularly in Judge Keller's absence, and the episode will be handled the same way it would, say, if Ted Cruz had been attorney for the accused. While some commenters have expressed (justified) skepticism that Judge Keller and Co. will do the right thing, I remain hopeful, in part because I don't think the court would have accepted the case if there weren't five judges inclined to disfavor scent lineup evidence. [read post]

Judge Sam Kent's impeachment by the US House of Representatives is not surprising news, but certainly welcome.Meanwhile, I'm disappointed to learn Court of Criminal Appeals Presiding Judge Sharon Keller's removal hearing on August 17 will take place in San Antonio, not Austin - mostly because I'd hoped to attend and cover the spectacle.
