What the father in M v D did is on a scale I’ve not seen, but I don’t think that it would be accurate to suggest that no parent has ever thought of embarking on a spot of covert recording in a misguided attempt to protect what they see as the best interests of their child, or even to suggest that there are not lots who have once or twice, discreetly pressed record on their iphone at a critical moment. As to the former, this simply follows from the fact that, in our society, mothers are usually better placed than fathers to be residential parents - it is simply down to what is best for the welfare of the child, not any conspiracy against fathers. [read post]
