Austrac has released draft AML/CTF Rules exempting superannuation funds from carrying out the customer identification requirements of the AML/CTF Act on customers where the superannuation account balance is not greater than $1,000, the whole of the interest of the customer in the superannuation fund has been cashed out and the customer's account is closed as soon as practicable after the cashing out. Austrac has issued draft AML/CTF Rules (pdf)to allow customers who acquired interests in a managed investment scheme between 12 December 2007 and 30 January 2008, to be treated as pre-commencement customers under the AML/CTF Act, so that the identification procedures requirements do not apply to them. Item 12 inserts new item 20A in table 1 in subsection 6(2) which will mean that a designated service is provided when a trustee or manager of a trust issues a debit card that enables a signatory authorised by the holder of a beneficial interest in the trust to debit an account held by the trustee or manager of the trust held with an ADI, a bank, a building society, a credit union or a person specified in the AML/CTF Rules.
